If memory serves, in 2007 the Supreme Court ruled that the EPA could regulate greenhouse gases under the Clean Air Act if it found that those gases posed a risk to human health which they did in 2009. But there has not been a court challange yet.
I'll bet this gets tossed.

Where to start?
Does burning coal pollute the air? Yes.
Is the measure of that pollution carbon, per se? Probably not - unless the carbon itself is considered a pollutant. Never forget that we ( but not Obama?) are carbon based life forms.
I think the real message here is more like, "The Capitalist running dogs must be punished for using the resources which belong to the people." Where 'people' means the 'people' of the undeveloped world and the Marxist world (high degree of overlap - irony lost on Marxists).
