Rush to Rush Limbaugh STOP USING OUR MUSIC ... or Else
TMZ ^ | 3/7/12 | TMZ Staff

Posted on 03/07/2012 3:33:40 PM PST by raccoonradio

The '80s have come back to bite Rush Limbaugh in the ass ... Rush (the band) has followed Peter Gabriel's lead and have demanded Limbaugh stop using their music on his radio show ASAP.

Rush (the band) was FURIOUS when they discovered Rush (radio guy) was playing their song "The Spirit of Radio" as he ranted about wanting to see sex tapes of Sandra Fluke. The band got even more upset when they learned it wasn't the first time Rush (radio) has used their music on his show.

The band has since fired off a cease and desist letter to Rush (radio) ... saying, "The public performance of Rush’s music is not licensed for political purposes and any such use is in breach of public performance licenses and constitutes copyright infringement."

The letter continues, "Accordingly, we hereby demand that you immediately stop all use of Rush’s music and confirm that you will do so."

As for Peter Gabriel ... his song, "Sledgehammer" was playing on Rush's radio show when he called Fluke a "slut" ... and, shocker, Peter's pissed too.

Gabriel's rep said the singer has demanded that his music also be pulled from Limbaugh's show.

He should sue them for stealing his name. He was born before they started using the name Rush.

Someone I know helped Rush (the band) out...when she worked for a Cle. radio station, she suggested they start to play this Canadian band. The woman--a liberal-- has since been thanked by Rush, the band, for helping to "break" them in America.

The song is also used on Fox Sports Radio's JT The Brick show (syndicated by Clear Channel/Premiere). Host John Tournour is a conservative (his sports flash reader, Tom Looney, is a liberal). After the opening segment, JT introduced THE LONG TIME VOICE! THE ICONIC VOICE of Tom Looney, and they start to play Spirit of Radio. Begin the day with a friendly voice, a companion unobtrusive...

Holland Cooke writes on radio-info.com:

“Artists or labels own their work.
ASCAP/BMI fees stations pay compensate composers.
Talk stations’ blanket “Incidential Use” license covers just-that.
Adopting-someone’s-music-as-a-theme-song not covered.
(Nor, incidentally, is using-music-in-commercials, without permission, something many stations overlook.)

Didn’t Chrissie-what’s-her-face of “The Pretenders” do that in the 90s in an effort to stop Limbaugh from using her song as his theme song?

He pays for that.

You might remember when, several years ago, The Pretenders told him to knock-it-off, he used various-other-songs while negotiating, explaining on-air that that was the case.

That’s actually surprising considering how right-Objectivist Rush is. Of course, as Objectivists, Rush (band) may be upset they aren’t getting royalties or credit.

I’m sure MahaRushie has learned from history and has secured licensing to use the music he does, and will continue to do as he’s licensed to do.

These people need to get over themselves. I can’t even remember who they are. I wouldn’t know if Rush Limbaugh used their one time hit or not.

I don’t listen to Limbaugh for music. LOL

Artists can’t control the use. The best they can hope for is a finding that they were not compensated.

Someone has already mentioned “incidental use” — that pretty much covers this use.

So to Getty Lee and the rest of Rush (the group), I say: “take off, you hosers.”

Limbaugh oughta start using this:

The B side would be particularly appropriate if he continues talking about the likes of Sandra Fluke.

I’m quite certain that as producer of a nationwide radio program that Rush Limbaugh has been paying the appropriate royalties for the public use of these songs. It’s very rare that an artist can actually do anything about the circumstances in which their music gets played unless the royalties haven’t been paid.

They don’t own the music, only the royalties, which Rush pays.

Rush gets the last laugh on rush.

Meanwhile...these bands and performers had no problem with drugs, anonymous group sex in the 80’s....Apparently they’ve all discovered chastity, sexual abstinence and clean living...

>>as Objectivists, Rush (band) may be upset they aren’t getting royalties or credit.

They must get some royalties in general ASCAP or BMI payments. Sometimes in radio they can get away with running a half minute or so of a song and that’s it (similar to the 30 sec samples on amazon.com). If they play the whole song,
and it’s entered into DMCA (Digital Millenium Copyright Act)
-related software, they may get royalties based on that. I’ve been a longtime college radio DJ and I have to enter in
song title/artist/album every time I play a whole song.

Song: The Thrill is Gone
Artist: B.B. King
Album: King of the Blues Box Set

Rush isn’t playing the whole song. Using it for bumper music. But they still may get royalties somehow.

Peter Gabriel expressed disgust at the use of Sledgehammer. Years back, Bruce Hornsby wasn’t happy that Hannity’s
radio show used The Way It Is

And of course we all know how pure as the wind driven snow the band was on tour, right? Not once did any of them abuse, take advantage of, use for sex, feed drugs or alcohol to, gangbang, whatever, teenage girls (and probably underage ones too)

Such hypocrites...yeah, you’re for women alright....slutwomen.
