Dariano v. Morgan Hill Unified School District (N.D. Cal.), decided the day before yesterday, upholds a California high schools decision to forbid students from wearing American flag T-shirts on Cinco de Mayo. (See here and here for more on this case.)
On Cinco de Mayo in 2009, a verbal exchange and altercation arose between a group of predominantly white and a group of Mexican students. This altercation involved an exchange of profanities and threats were made. A makeshift American flag was put on one of the trees on campus. A group of Caucasian students began clapping and chanting USA as this flag went up. This was in response to a group of Mexican students walking around with the Mexican flag. One Mexican student shouted fuck them white boys, fuck them white boys. VicePrincipal Rodriguez directed the minor to stop using such profanity. The minor responded by saying But Rodriguez, they are racist. They are being racist. Fuck them white boys. Lets fuck them up. VicePrincipal Rodriguez removed the minor from the area....
When Plaintiff M.D. wore an American flag shirt to school on Cinco de Mayo 2009, he was approached by a male student who shoved a Mexican flag at him and said something in Spanish expressing anger at Plaintiffs clothing....

They deny logic, reason and science which will destroy “Rule of Law” and create bizarre, unequal, arbitrary laws, based on barney frank standards and not based on the philosophy of the Constitution and Legal System.
What they are doing: destroying Natural Rights under God.

Here, for the reasons discussed above, Defendants have provided a non-discriminatory basis for asking Plaintiffs to remove their American flag attire. Defendants have put forth significant evidence demonstrating that Plaintiffs were asked to change clothes in order to protect their own safety. Plaintiffs have not offered any evidence demonstrating that students wearing the colors of the Mexican flag were targeted for violence. To the contrary, the undisputed evidence shows that Plaintiffs were the only students on campus whose safety was threatened that day, at least to the knowledge of Defendants.
According to the court, the school (defendant) does not have to ensure that all students can safely wear a chosen flag or else enforce a "no flag" rule for everyone. Instead, the court rules that the school can forbid students for their own safety from wearing a flag, and take no steps against those who threaten their safety.
The culture war is over, America lost.
All Mexicans are Spanish descendants. They don’t speak the native language (any of the 63) and they don’t know their own history. They think that they owned the Southwest before Spain. I think that the Navaho’s, Apache’s and Hopi’s might disagree with that.
This isn’t over yet, not by any stretch of the imagination.
We went from a ‘melting pot’ to a ‘tossed salad.’
Where does their salary come from? Tax Payers. Duh?
It’s a very slow painful death. No one will stand up the way the other groups have come together to destroy our country in the name of their culture.
Sad! Thank goodness one of our greatest generation of people are just about gone so they don’t have to see it.

not over if we speak out on social issues, the only reason the left has nearly destroyed this country is because many stayed silent because of PC.
Well I for one will not shut up and I will speak out on normal marriage, their agenda and issues like this.

I suggest Congress move immediately to suspend 1 day of federal funding for all federally funded programs in the school district.
If our flag isn’t welcome, then neither should our money be.
And all American students should stay home that day. AND wear little American flag pins every day of the year - except “hooray for ignorant Mexican day” - which they can all celebrate - by breaking some law of their choice, or maybe denying rights to others.
In fact - now that I think about it - I now declare Cinqo de Mexico = “Break any Law you Want” day. Maybe we could all go to Mexican restaurants - and pay with stolen ID.
we need more Americans with ball to put a stop to this. I hear this and feel like burning the Guadalupe virgin in effigy.
I think we're almost out of time to turn this around.
When will we stand up and be counted?

Well when I said descendants I was meaning that the Spaniards interbred with natives. Mexicans today are more Spanish than Mexicans. Once I was told by a Mexican that I should go back to Europe. I’m native American, I was born here. I told him to go back to Mexico or Spain if he didn’t like it here.
1. I think the flag should be held in higher regard. I don't wear American flag clothing, and I don't approve of it on others.
2. Despite that view, it's a form of protected expression, whether the kids intend it as respectful or not. The school should enforce order but not censor.
