The House Judiciary Committee will mark up a bill from Chairman Lamar Smith (R-Texas) on Thursday morning that would require all U.S. employers to use E-Verify, the Department of Homeland Security system that checks whether new hires are eligible to work in the United States.
Smith called on President Obama to make E-Verify part of his jobs plan on Monday, arguing the law could open up millions of jobs for legal residents as the unemployment remains above 9 percent. The program checks candidates' Social Security numbers against a federal database to verify they are allowed to work in the U.S.
A federal E-Verify requirement is needed now more than ever," Smith said in a statement sent to The Hill.
"Nearly 14 million Americans cant find work but at the same time seven million illegal immigrants work in the U.S. Congress should pass the Legal Workforce Act and the President should sign it into law unemployed Americans cant wait any longer.
Federal contractors are already required to use E-Verify, which Smith characterized as a simple, straightforward way to ensure employers aren't hiring illegal aliens for open jobs in an op-ed published Tuesday in The Hill.
"The 'E' in E-Verify could just as well stand for 'easy' and 'effective.' It takes only one to two minutes to use per new hire and immediately confirms 99.5 percent of work-eligible employees," Smith said.
"Even though E-Verify is not mandatory, many businesses voluntarily use the program. Nearly 290,000 American employers use E-Verify and an average of 1,300 new businesses sign up each week," he said.
While Smith noted that the vast majority 99.5 percent of individuals are immediately confirmed as eligible to work, the remaining half-percent remain a major concern for groups such as the American Civil Liberties Union that oppose making E-Verify mandatory. While a portion of those cases are ineligible workers, DHS has also previously acknowledged that some workers are erroneously rejected initially and must petition to have their status reviewed. Critics argue those workers are essentially barred from working through no fault of their own, until DHS corrects the error.
But the program has a long list of supporters, including the U.S. Chamber of Commerce, the National Restaurant Association and the National Association of Home Builders. The bill has met stiff resistance from agricultural producers, who rely heavily on illegal labor to harvest fruits and vegetables.

When has the Obama administration ever done anything to help businesses? If it were helpful for businesses, why would he be pressing to make it mandatory?
Imagine a world where someone was registered as a non-union getting and E-Verify result that came out negative?

As a voluntary system this is barely tolerable. As a mandatory system, this opens the door to unbridled evil.

No argument about what good it might do comes anywhere close to the horror this visits on our nation. And this violation of our individuality is just the last in a long list of violations, the gradual elimination of Americans as people who have their own unique, personal destiny of their own making. It doesn’t look like the Obama administration nor Dems are pushing for this, the Repubs are. DHS and Napolitano tried to say some time back that this program wasn’t mandatory but when backed into a corner she admitted it is but is being phased in. The Repubs want a bill to make it mandatory now.
I have no problems with it as a voluntary tool, but as a mandate, no, it’s wrong.
What is going to happen is that the power and control is going to be misused, as it always is.
The businesses should be responsible for screening employees, but their degree of screening should be up to them, not the state.
If it’s mandatory than a false positive will destroy good people. What is there to stop a government employee with a vendetta against your business from preventing you from preventing you from hiring people?

Will it force businesses to do something which they’ve been voluntarily able to do, but have chosen not to do? Yes.
Are there problems with the system at present? Also yes.
Is one of those problems the fact that the system isn’t designed to deal with identity fraud? Also yes.
So if I’ve lied, please state what and where I have lied. I believe this to be a bad idea. My experience has been that you cannot fire someone who has failed this until their appeal has been heard.
Why do I know this? Because I’ve been involved on the employer side of this and have seen other employees go through the process.

Eight of the Special Indicators have to do with fraud of some kind. I do not think that special indicator #6 was even available until long after Obama started using the SSN in question. It looks to me like the SSN Obama is using has been flagged with a Special Indicator indicating fraud.

Each SS-5, application for SSN, is examined and supporting documents are verified by an examiner at the SSA. The results of the examination and verification are coded under specific policies and procedures.
Examining Obamas alleged SSNs and applications is not enough. The results of the examinations of the documents provided with each application is what is important.
Orly is asking for the form his case manager in Connecticut filled out and nothing more. It proves nothing ... other than Obama had a case manager located in Connecticut handling his legal paperwork. A person in fostercare isnt eliminated from being eligible for POTUS.
Orly needs to get the code generated by the SSA after the SS-5, Application for SSN, was processed.

Not true. I oppose it because there are better ways to drive illegals out of the country and because I don't want the government keeping databases on the people capable of controlling their commerce. It's invasive, it's immoral, and it's an illegal warrantless search for a criminal who has not exhibited probable cause.
Want something more effective? Try a bounty system with stiff penalties for false arrest. The illegals would flee in a heartbeat.
