Rick Perry Categorizes Abortion as a States' Rights Issue

ABC News' Arlette Saenz (@arlettesaenz) reports:

Despite holding personal pro-life beliefs, Texas Gov. Rick Perry categorized abortion as a states’ rights issue today, saying that if Roe v. Wade was overturned, it should be up to the states to decide the legality of the procedure.

“You either have to believe in the 10th Amendment or you don’t,” Perry told reporters after a bill signing in Houston. “You can’t believe in the 10th Amendment for a few issues and then [for] something that doesn’t suit you say, 'We’d rather not have states decide that.'”

The 10th Amendment reads: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

Totally disagree . . . the Declaration of Independence mentions Life, Liberty and the Pursuit of Happiness. Without LIFE, nothing else if of any concern. The whole sordid and bloody mess should be overturned exactly as it was ruthlessly enacted . . . by the Supreme Court . . . it is a profound national issue.

That would be the practical effect of overturning Roe v Wade anyway. What matters most is if he will appoint conservative judges who will overturn Roe. From that point the states can begin banning abortion on their own.

Legalized abortion is a violation of the Fourteenth Amendment.

Who says so? The U.S. Supreme Court, that’s who—in Roe v. Wade. All Congress has to do is find that a human fetus is a “person within the meaning of the Fourteenth Amendment,” and Roe v. Wade becomes a scrap of paper.

If Rick Perry does not know this, then he’s not a pro-lifer.

I was very excited about Perry but now he is starting to concern me with this statement and the one the other day about homosexual marriage in New York. I’m on board with the 10th amendment too, but the tone he uses on these quotes seems to be giving aid & comfort to the left.

State’s rights never trump individual rights. Individual rights are the be-all, end-all.

I agree with him all the way.

Give it to the states and there will be less abortion.

It certainly isn’t the business of Gov’t to murder unborn babies.

Agree. He is right. First Roe needs to be overturned. No Constitutional Right to abortion. Then the States have their say. If will not work any other way. I agree with him.

In theory I actually agree with him on this one. Unfortunately we all know it will never work that way for long.

My militant lesbian cousin says she won’t rest till her “civil rights” are upheld in every state.

I believe in giving using the State by State approach as a strategy for attacking the problem but we should be careful not to do it in a way where we say a State has jurisdiction over individual rights- especially the very right of existence.

Actually, he is exactly correct. The only way to change that is to amend the Constitution to make abortion a federal matter. And he has been consistent in his position concerning the 10th Amendment.

Yes, BUT.
Had this been considered a states right issue like damn near everything should be ya gots to know a hole passel of babies would be alive today.
States like N.Y. and Mass. and Calif are going to push it no matter what.

It always was a states’ rights issue until the feds poked their noses into it. Almost all of them had made it illegal if I am not mistaken.

Murder is, in fact, also a state issue which is why the State tries your run-of-the-mill murderers not the Feds.
