OUTRAGE: Fury erupts over Ohio police video; NW activists join debate(CCW)

A profanity-laced dash-cam video from a Canton, Ohio police car that shows a street cop threatening a legally-armed citizen with felony charges, and possible execution, is racing across cyberspace at warp speed, enraging gun rights activists all over the country, including the distant Pacific Northwest.

According to CantonRep.com, the police department has begun an internal investigation. The officer is identified as Daniel Harless, and he has been on sick leave since Monday of this week, the newspaper said. He has also been placed on administrative leave. My colleague, David Codrea, writes about the incident here.

The video, now on YouTube, was posted Wednesday by Ohioans for Concealed Carry (OFCC). It shows a June 8 roadside encounter involving two Canton officers and three citizens in a parked car. The man seated behind the wheel of that parked car was arrested because he allegedly did not advise Harless fast enough – as is required by law in Ohio – that he was armed. There is no such requirement in Washington State. OFCC is definitely making an issue of this case.

On June 8, 2011 the following unfortunate arrest took place in Canton, OH. Notifying the policy when you have a firearm is required by Ohio Law, but when this individual with a thirty-day old license tries to do that he is repeatedly ordered to look away, shut up, or interrupted and "forced" to change what he is speaking about by the actions of an aggressive cop who maintains verbal control of the situation. A two man car dealing with three people put itself at risk when one officer started what appears to be an illegal search of the rear of the car without extracting or securing the driver - which would have given him an opportunity to notify.

I had something similar happen to me in CA.
Two drunk off-duty officers assulted me in a public park for sitting on the wrong bench. (They wanted it for their drunk party)

One guy jumped over the table and came at me.

This happened nearly 15 years ago so its not a new thing.

I just watched this video on Youtube, and sent it out to oh, say about FOUR HUNDRED people or so who will be sending it to many, many more folks.

Let’s be clear: HE THREATEND TO EXECUTE A LEGALLY-CARRYING CITIZEN - WHO TRIED TO INFORM HIM MULTIPLE TIMES.

And HE used the word “execute” with his partner as a witness.

This P.O.S. cop needs to be in jail. He’s a DANGER AND A THREAT to citizens. Let’s see how tough he is in a jail shower with three or four Bubbas.

From the get-go, he told the driver to shut his mouth, stay n the car, don’t say a “f*cking word or you’re going to jail...”

Throw this piece of garbage in jail, strip him of HIS right to carry a firearm, and commit him to SERIOUS psychiatric/ psychological threatment.

He and other cops like him are a DANGER to the rest of us.

And by the way - his partner did NOTHING to defuse the situation. He should be relieved of his JOB too.

F***ing garbage with a badge and gun.

That’s not the case where I live. The cops use unmarked cars AND pick-up trucks to stop speeders. I’ve seen it numerous times. That violates the rules of engagement IMHO. If cops are going to issue speeding tickets, use a marke car.

One more thing. I don’t know what it’s like in your neck of the woods but where I live, I have seen speeding stops where two and sometimes three cop cars are used. To me, that’s a misuse or resources, not to mention overkill.

This happened some years ago in St. Charles, Missouri (across the Missouri River from the St. Louis area): a drunk, off-duty cop picked a fight with a civilian in a bar, and the civilian took him up on the offer and punched him. Cop fell backwards and hit the back of his head when he landed. Cop died. Civilian went to prison for many years for killing a cop. True story. Moral of the story: cops are a protected and highly prized species, even when they’re trying to hurt or kill you - on duty or off.

There was a previous investigation of another incident without a recording, and he was let off.

I’d read this story on other sites before but hadn’t bothered to watch the video before now. I’ve seen a number of videos where cops have had (inappropriate) reactions to being provoked, and expected that there had to be some cause for the officer’s behavior as I’d read it described.

Nope. None. The officer is in severe need of anger management and possibly drug rehabilitation (as flipped out as he was, he might be chasing the ‘roids with some white powder from the evidence locker). He can get both of those during the couple years he needs to spend in prison after losing his badge and his pension. Pension money can go towards the six figure settlement for the guy whose life he repeatedly threatened, and whose civil rights he threatened to violate. His partner, Officer Milquetoast, didn’t really participate, so he should just be fired and barred from ever working in law enforcement again.

Was there ever any justification for the encounter in the first place? The car wasn’t even moving at the time they “stopped” them. Seems to me they could have just declined to speak to the cops and left, although the lunatic cop might have started shooting at them if they had.

In Memphis, it is now the norm for 2 or more cars to be at every stop. I backed out of my driveway last year, and 2 cars came from no where, pulled me over and issued me a ticket for running a stop sign. I was in my car less than 20 seconds before the stop.

I see it every single day.

Moral of the story: cops are a protected and highly prized species, even when they’re trying to hurt or kill you - on duty or off.

Plummer v. State, 136 Ind. 306.

“Citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529. The Court stated: “Where the officer is killed in the course of the disorder which naturally accompanies an attempted arrest that is resisted, the law looks with very different eyes upon the transaction, when the officer had the right to make the arrest, from what it does if the officer had no right. What may be murder in the first case might be nothing more than manslaughter in the other, or the facts might show that no offense had been committed.”

“An arrest made with a defective warrant, or one issued without affidavit, or one that fails to allege a crime is within jurisdiction, and one who is being arrested, may resist arrest and break away. lf the arresting officer is killed by one who is so resisting, the killing will be no more than an involuntary manslaughter.” Housh v. People, 75 111. 491; reaffirmed and quoted in State v. Leach, 7 Conn. 452; State v. Gleason, 32 Kan. 245; Ballard v. State, 43 Ohio 349; State v Rousseau, 241 P. 2d 447; State v. Spaulding, 34 Minn. 3621.

“When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justified.” Runyan v. State, 57 Ind. 80; Miller v. State, 74 Ind. 1.

These are tough economic times in the River City. They need all the money they can get. If that means hitting on people like you, so be it. They don’t care. They’re after bucks. Bartlett is bad. Everywhere you look is a cop waiting for prey. There must not be any crime in Bartlett. The cops there have turned their full attention to issuing speeding tickets. Or so it seems.
