It will no doubt be appealed. The final confrontation will happen at the Supreme Court, where I think there are 5 votes for repeal. 4 “solid” votes, and I believe Anthony Kennedy will rule with conservatives. He’s said things critical of Obama’s overreach and of the health care law.

If any part of the 2000 pages of Obamacare is declared unconstitutional, the whole shebang is void.

Without 1501, the funding mechanism is gutted. GOP can now lay seige warfare to strangle the rest....and that’s not counting what the 4th and SCOTUS will do to this bill.
The first blow, hopefully more to come.

Greta says DOJ will fight it by calling it a tax... Legislators didnt want to call it a tax for political reasons... But DOJ lawyers call it a tax in defending it... If they argue that it is a tax, don't they then have to get around Article I Section 9 Clause 1 "but all Duties, Imposts and Excises shall be uniform throughout the United States?"
How do they argue that this federal "tax" is "uniform" when the Nebraska "Cornhusker Kickback," the Florida medicare exemptions, and all the union waivers, make favored constituencies exempt from it?
