JUNEAU -- GOP nominee Joe Miller is asking a federal judge to keep the state from using discretion in counting write-in ballots in Alaska's hotly contested Senate race.
The lawsuit, filed Tuesday, comes the day before election officials planned to begin counting write-in ballots that could determine the outcome of the race.

Years ago in NY we had a major write in mess too...It took weeks but “intent” was thrown out finally and exact spelling, as everyone had been told in advance, was upheld.
Even then, bad handwriting had to be considered if there were enough wiggles to represent the correct letters.
The write in candidate lost.
This is a smart move.
Mark Levin didn't pull any punches when he was discussing this with Joe Miller and the AK Lt. Governor (on their respective nights).
He listened patiently to the Lt. Gov explain how the electoral commission would study the write-in ballots to divine the voter's intent. He then read back the Alaska state election law to him on the air. He then asked him point-blank, how that method of counting ballots comported with the LAW. The Lt. Gov actually paused and couldn't come up with a straight answer. It was pretty clear that Mark had just busted him in front of millions of listening Americans.
When he was talking to Joe Miller, he told him straight up that the Murkowski camp would steal the election unless he got his legal team on top of this immediately. Joe's a sharp cookie, but Mark sort of gave him pause, as well. You could tell that he had just been schooled by the master.
Make no mistake; Mark Levin just caused a major fire storm up there.
Totally agree....someone writes "Martoski".....how do they really know that the person didn't write mean Frank Martoski? They CAN'T...that's why the rule about exact spelling has to be upheld. Ridiculous.
No, it is based on “voter intent,” which gives liberals the wiggle room they need to win. In 1954, SC counted “Storm Thunder” as “Strom Thurmond.” AK is too liberal for Miller.

If she somehow manages to win through her cheating; I would address her as the “fake senator from Alaska”.
Per Alaskan electoral law, a write-in vote can't be counted for anyone, except that person whose name is written on the ballot. Period. End of story. There's nothing in their law that allows for a subjective analysis of a voter's "intent".
If it doesn't exactly spell MURKOWSKI, she can't take the vote. That's how their law is written.
So now it comes down to whether we get a court like the one that ok’d Lautenberg after the Toricelli implosion?
And it was the Lt. Gov throwing all the BS.
Mark caught him dead to rights, admitting on air that they were going to allow a subjective analysis of voter "intent" when counting the write-in ballots. Mark read the Alaska statute on-air and asked the Lt. Gov to tell him where it says in the law that they can do that.
It was interesting hearing the guy dance all over the place trying to answer that one. He couldn't, and Mark told him so.
I think the dude left the call with his head spinning. Mark cold busted his ass.
How would any voters be disenfranchised when they voted Miller in the primary?
