Very interesting. I can't remember a time where a federal judge rear-ended (pun intended) the people so overtly- and on top of it got the final say. I find that scenario hard to believe. But we do live in a bizzaro world it seems.

Yeah, but Judge Walker and his lot have a different definition of "equal" than what "equal protection" means. Equal protection means that the law is enforced equally upon everyone. Prop 8 was equally enforced so there was no violation of the clause.

You are probably right though, there are some recent cases that suggest that Kennedy is likely to side against Prop. 8 if it reaches SCOTUS. The court had better be cautious about redefining the clause though, because it could have a lot of unintended consequences.

The remarks on Shep’s chat room are almost as discussing.

I even tried to say something on it only to have my remark ignored.

I don’t understand how it is you can have a right to someone else recognizing and subsiding your activity as the State does marriage.

But the Federal usurper court does and as such we have a Nanny state whom a large number of dead beats are demanding their “right” to other peoples wealth, services, and recognition as being something other then an impostor.

It is indeed a sad state of affairs for theses once united States. I could only wish that we could ditch theses deadbeats and assume among the powers of the earth the totally separate but equal station as to deny them the possibility to rob us as they currently are using the government to do so.

Not necessarily. This is a difficult issue. Supreme Court precedent would indicate that if the state doesn’t take it forward, the interveners very likely don’t have standing.

How can you say the judge has defeated anything when the judge has the arbitrary authority to simply pick who wins and who loses? The Dictator didn’t defeat the he simply choose not to accept their position in pronouncing his dictates to overthrow the State constitution.

Judge Vaughn Walker is a FEDERAL judge not a Californian State judge. The only way to throw him out is retirement, death, or impeachment and Conviction by the US House and Senate. Everyone in the US can demand their representatives draft articles of impeachment against this judge.

So your saying that if a leftist state like California sets up a constitutional dispute in which they are doomed to loose and doesn’t win in the Federal court they can set the presidents which dooms all other states?

Meaning one state can thou deception and mistrials help force a political policy on every other state via dictatorial federal judges.

What a corrupt system I don’t care if this is what the authors of our constitution had in mind if this is what they had in mind we have all been made a fool in accepting it.

Its time to leave this cursed, lawless, and oppressive “union”.

however the appellate courts can issue a stay.

HOWEVER if the plaintiffs are just going to argue religion then we lose.

They have to defeat the “born that way” physical behavior assumption.
