SACRAMENTO - Judge Vaughn Walker has lifted a stay in order regarding last week's verdict that stated Proposition 8, California's law that defined marriage as a union between one man and one woman, is unconstitutional.
Absolutely disgusting.

It’s all over now.
Once there are gay couples married in California it will establish two classes of gay citizens and the SCOTUS and especially Justice Kennedy does not like separate classes and does love the Equal Protection Clause.
I guess all those “waiting in lines to buy marriage licenses” will have to go home................

Yes, they will be going home with marriage licenses.
He did not lift the stay according to Sean Hannity. He put his decision on hold until maybe the 19th.
If he lifts the stay then he will have, effectively, silenced the voice and will of the majority of Californians.
No. It means that Prop 8 is overturned and that gay marriages can immediately begin in California. Other states will then no doubt be forced by other judges to recognize them...and there you go. The will of the people disregarded, and 2-3% of the population have triumphed.

Walker seems to imply that those defending Prop 8 wouldn’t even have standing to appeal, so that this case can’t go to the Ninth Circuit or SCOTUS. He did stay the entry of judgment until August 18th, I don’t know if that is enough time for the proponents of Prop 8 to get a Stay from the Ninth Circuit, or SCOTUS.
This whole country just got bent over.
“Last week, Walker invalidated Proposition 8, which was passed by voters in 2008 and bans same-sex marriage in California, but he immediately put in place a stay that froze enforcement of his ruling.
His action - expected between 9 a.m. and noon - will either lift the stay, which could enable gay and lesbian couples to get married, or to leave it in place, which would maintain the ban.”
I don’t know what’s worse: the behavior he’s condoning or his behavior in condoning it. He’s shown utter contempt for the institution of marriage, the rule of law, and the robe he wears and the oath he took to put it on.
Lifting a stay is NOT a good thing, at least in this case.
