Isn’t this Judge lifting the stay a good thing or am I missing something??
No. It means that Prop 8 is overturned and that gay marriages can immediately begin in California. Other states will then no doubt be forced by other judges to recognize them...and there you go. The will of the people disregarded, and 2-3% of the population have triumphed.

“Last week, Walker invalidated Proposition 8, which was passed by voters in 2008 and bans same-sex marriage in California, but he immediately put in place a stay that froze enforcement of his ruling.
His action - expected between 9 a.m. and noon - will either lift the stay, which could enable gay and lesbian couples to get married, or to leave it in place, which would maintain the ban.”
Lifting a stay is NOT a good thing, at least in this case.
“None of the factors the court weighs in considering a
motion to stay favors granting a stay. Accordingly, proponentsmotion for a stay is DENIED. Doc #705. The clerk is DIRECTED to United States District Court For the Northern District of California enter judgment forthwith.
That judgment shall be STAYED until August 18, 2010 at 5 PM PDT at which time defendants and all persons under their control or supervision shall cease to apply or enforce Proposition 8.”
