PHOENIX A judge has blocked the most controversial sections of Arizona's new immigration law from taking effect Thursday, handing a major legal victory to opponents of the crackdown.
The law will still take effect Thursday, but without many of the provisions that angered opponents including sections that required officers to check a person's immigration status while enforcing other laws.

No surprise here.a Clinton appointed judge
I guess innocent citizens have their civil rights violated EVERY TIME the police investigate suspicion of ANY crime. Is there any other conclusion?
Certainly every time a protected minority is investigated.
Should apply to burglary, murder, rape, etc.
Impeach her!!
THE ACLU now runs and decides things not US. I see BIG problems ahead and I’m all for making BIG PROBLEMS ahead.
“There is a substantial likelihood that officers will wrongfully arrest legal resident aliens,”
This is absolute nonsense. Legal resident aliens are the LEAST likely group to be arrested under this provision. They are already required by Federal law to carry their Resident Alien cards (green cards) at all times, so they should always be able instantly provide proof of their right to be here to any LEO.
An American citizen is far more likely to be temporarily detained, as they are more likely to go out without ID. These rare incdidents would be little more than annoyances, as any citizen should be able to clear up his status rather easily.
Of course, 99.9% of the arrests would be of actual, illegal aliens.
Fox News Legal analyst Peter Johnson(Democrat)
“It’s a rather long ruling, some 36 pages in length. In terms of a legal argument, I’m not very impressed”
Will this quiet some of the knee-jerk FOX detractors on FR?
Probably not.
As soon as I saw that this judge was a Clinton appointee, I knew her decision would be based on some nebulous, politically-correct, standard of “fairness” and not a strict adherence to the Constitution and the rule of law.
We are no longer a nation of laws drafted by legislatures.
We are ruled by an activist judiciary, unaccountable “czars” and an ever growing, power-hungry, unelected bureaucracy.
I fear, as Sonny Corleone concluded in “The Godfather” that at some point we will have to “go to the mattresses” to save ourselves.
This is the best thing that could have happened. The anger is palpable.
Oh my god, you think November is REALLY going to change anything? Oh, by all means, go ahead, keep living in your fantasy world, keep pretending that right still makes might in this country instead of the other way around.
No. It should have become clear to all of us long ago that there is no hope... No matter who we vote for, The Government always wins. No matter how many Democrats we kick out of power, the people we replace them with will still be POLITICIANS.
To hell with November.
“That is already settled: http://www.firearmsandliberty.com/cramer.haynes.html"
This is FASCINATING! Thank you so much for the link. IMO you should start a separate thread with it focusing on how this would affect illegals.
I’m glad to learn this. Thanks again!
It’s about time we started playing by their rules — not pay taxes, not carry ID, bury whatever savings we have left in the backyard, bring my uncle over from a foreign land. Laws.... what laws?
IMO, Ft Sumter was a mistake.
The way it should be handled [this time] is to completely ignore federal authority and jurisdiction. Don’t attack any federal or “blue state” property.
And, if the feds decide they want to use some sort of force to impose their will within that state, THEN the state “regiments” defend the state authority.
NO It simper, the States call a Constitutional Convention and do what necessary to put the federal back in line up to and including dissolve the Federal government if needed...
The Federal is a creation of the States by the Constitutional...
And the Federal it NOT DOING what it created to do by the States ..things like enforcing Immigration Law...
Instead the Federal behaves like the States and there people are Federal property...
The Federal government need to get a wake up call ... the Federal is a creation of the States via Constitution ....
And the 50 States have the ultimate say so on anything Federal via a Constitutional Convention...
States tell the Federal via the threat of a Constitutional Convention to do what the Federal was created to do (and only what it was created to do)...
Or Federal, you will be legally and Constitutionally dissolved by the States
I’m concerned Bolden’s wording re: not being in the public interest for a state to override a federal law also may put the slap to the states’ lawsuits pertaining to 0bamaCare’s mandate to buy health insurance.
If I were Governor Brewer I would issue the following statement:
I thank the judge for clarifying the relationship between the state and federal responsibilities. I have issued the following six executive orders to take effect immediately.
1. The state minimum wage law is now null and void. Employers only have to match the federal minimum wage. We do not want to preempt federal jurisdiction.
2. The state police is no longer to patrol any federal highway. We do not want to preempt federal jurisdiction.
3. The state department of transportation is to stop all maintenance on federal highways. We do not want to preempt federal jurisdiction.
4. There is to be no state or local investigation or prosecution of drug laws since the federal government has laws regulating such substances. We do not want to preempt federal jurisdiction.
5. All state convicts being held for crimes associated with federal law are to be immediately released. We do not want to preempt federal jurisdiction.
6. The Attorney General is to report to me all other state laws which relate to federal laws. We do not want to preempt federal jurisdiction.
"To Arizona!!! Everyone!!! Praise Allah!!"
The rule of law is only good if the laws and courts are good.
If not, there is no real difference between the rule of law and mob rule. It is a travesty.
Law Enforcement Officer
That made me laugh. But it’s really not funny.
Which is what the left wanted anyway. Gives them LOTS of time to moot the point by giving the illegals amnesty and citizenship.
