No, the offspring of ambassadors wouldn’t be “subject to the jurisdiction” of U.S. law, and therefore wouldn’t be citizens. But of course you already knew that. As for spies, if they weren’t here under cover of diplomacy, they’d have citizen children. That is, if they were good spies and didn’t get caught.

You and I and everyone we know knows that if SCOTUS were to rule on whether native born citizens were also natural born citizens (with or without two citizen parents), they’d rule in the affirmative. Not that SCOTUS is always right, but in this case the vast majority of experts and laymen alike would agree. Natural born citizen means to the civilized world citizen from birth. That’s all.

Hmmm.........So why did the founders use two types of Citizens in Article 2 Section 1 Clause 5?

No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.

Good grief.

Ark was not a natural born citizen, the Court was not asked to conclude as to such status, and would not have.

SCOTUS has defined this term in Shanks, Minor, Elg, Ark, and each time it’s parents who are citizens (plural).

Further Vattel notes that:

The natives, or natural-born citizens, are those born in the country of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights.

“Every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen.”

It’s very clear what the intent of, and what the actual requirement is.....why do we keep pretending?

No, we don’t all know that. I, for one, know that native born citizens can be president.

Birthers like to pretend there's a difference between native born and natural born. There isn't, not as far as citizenship is defined in law. If you're born here, you can be President. If you're naturalized, you can't. It's that simple.

Obama’s father was NOT an American citizen. Thus, Obama is ineligible to serve as President regardless if he was born in Kenya or those 2 hospitals he claims in Hawaii. And while we are on the subject, he was born in Kenya.
