Obama administration defies congressional subpoena on Fort Hood documents

The Obama administration said Tuesday it would provide more information to Congress about the Fort Hood shootings but continued to defy a subpoena request for witness statements and other documents.

After days of negotiations, the Pentagon and Justice Department informed a Senate committee that they would not comply with congressional subpoenas to share investigative records from the Nov. 5 shootings at Fort Hood, Tex., which killed 13 people.

How would the administration have access to something like that before Congress, and on top of that how could they not share the information?

The governing and regulating of the military is the province of the US Congress. And we haven't even mentioned the power of the purse.

Since my point is that the Congress can demand an investigation of the Ft Hood shooter whether the president agrees or not, then you have to ask yourself what about this case applies to "when called into the service of the United States."

It was on our soil, and there were no enemy maneuvering armies that Hassan was avoiding.

Our Senators are perfectly, and Constitutionally in the right in demanding and even setting up and investigation to which members of the military MUST comply or be held in contempt of Congress.

How would the administration have access to something like that before Congress, and on top of that how could they not share the information?

I'm just guessing here, but didn't the justice department do an independent investigation? And if so, the justice department isn't under congress.

It is safe to say that Obama is not only getting the benefit of the doubt from the press but they are actually burying stories to protect his regime.

Yes, this is correct. And I agree with you; however, POTUS does control the military. Hence Congress is going after the Obama adminstration and not the military, and the federal law enforcement entitites, directly/individually. The reason is congress dictates rules and regulations. Obama has the control over the military to execute the laws, rules, and regulations set forth by congress.

The same can be said for almost any federal institution. The legislative branch writes the policy (laws, regulations etc) and the executive branch controls the institution through its execution of the policy.

Congress has the power to demand an investigation into Toyota. That doesn't mean they control Toyota and can dictate that rear passenger seating must have DVD/Blu Ray as a standard option.

All of this is part of the checks and balances. Congress has the power to write legislation. They also have the power to investigate to ensure the executive branch carried out the law. The judicial branch has the power to interpret the laws the legislative branch wrote. The power over (through lawful orders) the military is retained with the POTUS.

It is part of the reason the servicemembers are refusing orders because of the birth certificate issue. If congress had control over the military, the point would be moot.

As far as the "power of the purse." Yes, congress could manipulate the military through it's budget. But, I'm sure you and I could both agree that the Founders probably would have found the agenda driven toying with national security an abuse of power.....

A good way for MSNBC and CNN etc, to get more viewers would be to start doing huge stories on all the corruption that they are now sweeping under the rug. People would tune in by the millions.

I agree if CNN etc actually started to report all of this corruption and stated how obama is siding with the illegals, seat for sale, vacations, etc then obama’s numbers would go down but he likes of CNN would see their ratings go up.

I know I’d watch them if they were not corrupted
