The Slaughter Solution: The Metamorphosis of The American Republic Into Government By Fiat
David Horowitz's NewsRealBlog ^ | March 14 | Liz Blaine

Posted on 03/14/2010 1:31:24 PM PDT by callisto

fiat [ˈfaɪət -æt], n., a legally binding command or decision; an arbitrary order or decree

A very dangerous act is being attempted by the Left to secure their rule over the American people and transform the legislative process from a Constitutional Republic to a government by fiat. Today on Fox News Sunday, Democratic leader Rep. Chris Van Hollen admitted Democrats intend to use the unconstitutional “Slaughter Rule” as a solution to ram nationalized health care through Congress without majority vote and in defiance to the will of the American people.

The Slaughter rule would declare that the House of Representatives “deems” the Senate health care bill “passed” by the House. House members would have to vote on whether to accept the rule, but would then be able to claim they only voted for a rule, not for the bill itself. In other words, Democrats will avoid a direct vote on the health care bill while allowing it to become law! They will take over one-sixth of the US economy without voting on it in direct violation to the legislative process defined by the U.S Constitution. Article I, Section VII, Clause II specifically states,

"Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States;... But in all such Cases the Votes of both Houses shall be determined by Yeas and Nays, and the Names of the Persons voting for and against the Bill shall be entered on the Journal of each House respectively."

You asked. I reply. I practiced in the Supreme Court for 33 years. Briefed 18 cases. Wrote and taught on constitutional law. I've written an article on the violation House and Senate rules by their own members. See below.

Do you agree that Title 8 USC, Sec 1401 is the current governing law on the issue of citizenship status?

Don't get me wrong. Obama is hiding something. I think it may be the place of his birth, (an emotional, but not really a citizenship-denying legal issue) and whatever documents he signed to get the foreign passport he used to travel years ago. There might have some oath of allegiance to other nation-state thereon.

Disregard # 141. Wrong issue.

Sorry bout that.

What do you think will happen if they try to play Constitutional games?

SCOTUS position? How quickly?

The more I think about it, it might take some time to reach SCOTUS.

At least for 5 years, it can be argued that this is only a ‘taxation” issue.

Those idiots who voted for Obama in '08 voted for the destruction of our nation.

The red son of a bitches Pelosi, Reid, Axelrod, etc. know full well that 44% of the electorate TODAY think the marxist in chief is doing a great job.

THE FIGHT IS WITH OUR "FELLOW CITIZENS" WHO PUT THESE COMMIE BASTARDS IN POWER.

And that problem doesn't get solved at the ballot box.

They have the IRS, the BATF, the DHS, and the media behind them.

THEY HARASS DISSENTERS WITH PHONY ETHICS COMPLAINTS OR DESTROY THEIR REPUTATIONS THROUGH THEIR PROPAGANDA ARM IN THE PRESS.

AXELROD KNOWS FULL WELL THEY HAVE THE UPPER HAND, AND ALWAYS WILL, AS LONG AS THEY DEFINE THE TERMS OF THE CONTEST.

Until and unless the GOP is willing to declare war on socialism and the "Congressional Progressive Caucus" and their fellow travelers, AND THAT MEANS THEIR VOTERS AND THE GEOGRAPHIC AREAS OF THE COUNTRY THAT SUPPORT THEM, all will be lost.

Time to name names, harass, threaten, and destroy the CPC and their propagandists in the press with whatever means they have at their disposal, ALL OPTIONS ON THE TABLE INCLUDING CIVIL DISOBEDIENCE AND DISRUPTION OF THE APPARATCHIK MACHINE IN WASHINGTON.

I have personally taken cases from trial court through Appeals and through the Supreme Court in less than two months. This can and will be vast track litigation.

It CAN be done.

Then-Representative Bernie Sanders was the convener and first. The founding members were concerned about the economic hardship imposed by the deepening recession, the growing inequality brought about by the timidity of the Democratic Party response at the time.

Additional House representatives joined soon, including Major Owens (D-NY), Nydia Velazquez (D-NY), David Bonior (D-MI), Bob Filner (D-CA), Barney Frank (D-MA), Maurice Hinchey (D-NY), Jim McDermott (D-WA), Jerrold Nadler (D-NY), Patsy Mink (D-HI), George Miller (D-CA), Pete Stark (D-CA), John Olver (D-MA), Lynn Woolsey (D-CA), and Nancy Pelosi (D-CA).

...has any Constitutional expert weighed in on this.

Not some legal bar fly, but someone with real Constitutional law credentials.

The US Constitution was written for, and bequeathed to YOU, by our Founders, my friend. You don't need an expert to read it, or interpret its clear meaning.

Article I, Section 7, Clause 2.

I hate to say this but I expect some sort of Reichstag event. That is to say, I believe the Obama gang will create an event that they will blame on some group...likely the Tea Party given that the groundwork for demonizing the tea partiers as angry, hateful and unbalanced is being laid.

I understand the need for a Judicial branch of government, but there's nothing from preventing you, a common citizen, from reading and understanding the Constitution. In fact, it's every American's duty to know and understand that document. It's the very foundation of our freedom.

Sure, we need to have sharp legal minds to represent the people's interest in the courts, but don't rely on so-called experts to understand the basis of your freedom for you.

fiat [ˈfaɪət -æt], n., a legally binding command or decision; an arbitrary order or decree

I am easily confused.

Can a command be both arbitrary and legally binding?

I am assuming we are discussing free societies, established to be ruled by the consent of the governed.

Otherwise legal can mean anything.

You realize that if this Bill passes the Republicans will never be able to repeal this without a 2/3 majority in the House and Senate!!!!

” This sounds a bit too conspiratorial for my tastes.

Let’s hope and pray that cooler and wiser heads prevail at the federal level and this monstrosity of a federal government rolls back toward it’s legitimate role as dictated by the constitution before the democrats destroy the nation. “

Unfortunately, History (the study of european, classical, and (hemispheric) american) is not on your side at all. I am not aware of any historical precedent on the scale you describe, in the manner you describe. Can you offer any?

I think this is a central motivating factor behind the national police force or whatever it was called. The military cannot be relied on in any forseeable future to enforce dictatorial rule domestically.

I will agree that likelihood and desirability may not be on the same page in this regard.

the russian polscientist who predicted a breakup of the US on geographic/social lines may represent a viable theory of one possible outcome of the long-term direction of the country (the other being much more repressive central authority). We certainly are well down the slippery slope, and the historical precedents of ongoing unified government are dismaying.
