Widow of Austin plane crash victim sues pilot's wife

(CNN) -- The widow of an Internal Revenue Service employee killed when a disgruntled taxpayer flew his plane into a seven-story building in Austin, Texas, last week is suing the pilot's wife, according to court documents.

Valerie Hunter, the wife of Vernon Hunter, is accusing Sheryl Stack, wife of Andrew Joseph "Joe" Stack III, of negligence, alleging she she knew or should have known that her husband was a threat to others and, thus, could have prevented the attack, according to the lawsuit filed Monday in Travis County District Court.

She's not being sued as the executor of the estate, she's being sued for negligence, or so the media reports claim. You're making it up, now.

How is it merciful to sue a widow over something her husband did unbeknownst to her?

She is the executor of the estate. Legally she has to be named in the suit.

It’s funny how your responses changed after this was posted. After that you started “educating” everyone on the facts of the case.

This thread is about nothing. It looks like CNN screwed the story up (big surprise!).

It seems the real defendant is Stack’s estate, of which Sheryl is the presumed executor. And the objective isn’t money, but rather to provide a context for the issuance of a restraining order to prevent the release of the victim’s autopsy details.

Maybe if I studied law at Occidental and Harvard I would have a clue as to the intricacy of our legal system.

As I see this, it is an uncontrollable act on the part of a madman.

Where Mr. Plohetski quotes the suit when it claims about the Mrs. Stack that she failed to ...

'avoid a foreseeable risk of injury to others.'

You can't sue the executor of an estate because he/she did not "avoid a foreseeable risk of injury to others.'.

You are REALLY making it up, now.

The CNN article still doesn’t make sense either.

The point many are making is that lawsuits are in play before there are any facts of culpability.

How's this, from FOX-7 in Austin.

The widow of IRS worker Vernon Hunter has sued Sheryl Mann Stack, the widow of Joe Stack. Authorities say Stack killed Hunter last Thursday when he flew his single engine plane into Hunter’s office building on HWY 183.

Sheryl lived with her husband and 12-year-old daughter in a home in northwest Austin. She and her daughter had spent the night at a hotel the night before the attack. Investigators say that Joe Stack burned the home down while they were away before he launched his plane attack. According to the lawsuit, Valerie Hunter claims that Sheryl Stack felt threatened enough by Joe Stack that she took her daughter and stayed at a hotel the night before the plane crash. 'She owed a duty to exercise reasonable care to avoid a foreseeable rush of injury to others including Vernon Hunter.' Sheryl Stack breached her duty to inform others which resulted in the death of Vernon Hunter. Valerie Hunter is asking for actual damages, exemplary damages, interest and court costs.

An attorney for Hunter told FOX 7 that the lawsuit will also seek to block the public release of Vernon Hunter's autopsy records.

Last week Sheryl Stack released a brief statement through a spokesperson. In the statement, Sheryl Stack thanked her friends and family and offers her "sincerest sympathy" for the victims and their families. She also said she will not comment further.

So, the wrongful death suit is in addition to the suit to prevent release of the autopsy details. Details, I might add, that are part of the public record.

It seems very clear that the widow Hunter holds the widow Stack responsible for her dead husband's actions. As stated in the FOX-7 story:
According to the lawsuit, Valerie Hunter claims that Sheryl Stack felt threatened enough by Joe Stack that she took her daughter and stayed at a hotel the night before the plane crash. As clearly stated in the wrongful death suit and according to the Hunter lawyer.

Coldwater, I was actually talking about you. You said you did your own research to OldDeckHand but the tone of your posts changed after CynWoody posted this new information.

You were all arguing about the CNN story and you were defending the actions of the IRS agents widow based on the CNN story. Why are you now scolding other for taking the information at face value.

After cynwoody posted the corrected information, you changed your tone and starting “educating” everyone on the real facts of the case.

If you had done your own research why didn’t you inform us of this before?

How much is keeping an autopsy private going to cost Mrs. Stack?

If Mrs. Hunter decides to drop the lawsuit will the autopsy be available to the public? Do they need to see the wrongful death case through to the end to keep the autopsy private?

Ripe for speculation.

And beyond that, the CNN article says the lawsuit is to protect the children’s which is BS.

They will deal with it just as the other family’s kids will.

Suicide is not universally excluded on life insurance. There is often just a time-frame exclusion to prevent you from getting a policy and immediately offing yourself.

The guy committed a crime, but I don’t see the logic or justice in punishing his wife for it.

Whatever. I am out of here tonight. Been fun seeing a bunch of haters line up and post based on a CNN article that is not fully informative and in fact misleading of the facts.

It happens all the time. A liberal rag will post some 'statement' made by a republican and suddenly a thread on FR appears railing the republican for something that was taken totally out of context.
