Breitbart Claim: Jailed O'Keefe Couldn't Access Attorney For Hours

Interviewed on Fox just moments ago, Andrew Breitbart claimed that alleged Landrieu phone tamperer James O'Keefe "sat in jail for 28 hours without access to an attorney."

Breitbart, who has been on a public campaign defending O'Keefe, a paid contributor to Breitbart's BigGovernment.com, also charged that the U.S. Attorney's office in Louisiana leaked information to the press "helping" them to frame the episode as "Watergate Junior."

Breitbart complained that after the news of the arrests broke last Tuesday, O'Keefe's attorney and Breitbart himself were being called by the media but they could not locate O'Keefe -- "and that's because he was sitting in jail without access to an attorney," Breitbart said.

He accused the U.S. attorney of leaking information to the media in a "concerted effort" to frame the episode in a way that would put O'Keefe in a bad position.

Asked by Fox's Megyn Kelly what motivation the U.S. Attorney would have to make such an effort, Breitbart responded: "Well, it's tied to the Justice Department. And we've been very aggressive in asking Eric Holder to investigate what's seen on the ACORN tapes, and he's ignored it."

He cant answer many of the questions on Hannity for legal purposes. Did you hear the charges?

The one where it says in the AFFIDAVIT that says they dressed up in telephone repairman gear, went into a federal building stated that they were there to look at the phones and then commenced to looking at the phones. You think that’s ok? Would you mind it if I went to your house and did that?

The government might have a case if they used false pretenses to enter a space they would not have been admitted to as general public. The senator's office was open to the general public at the time they entered.

I agree with you. O’Keefe is a silly young poseur...perhaps he should be auditioning for a TV reality show.

I put him in the same category as the Heenes. Just another attention whore.

The media should ignore him.

He is an ambarrassment to the Conservative movement.

Yep, in fact conservative hero Dick Armey who mobilized last years anti-Obama protests, and successfully beat the 1992 Clinton/Democrat revolution, was attacked for NOT embracing the ‘birth-certificate-ers’. Like Coulter and many others, Armey knew this BC craziness would be pure ammunition for the democrats. Armey was smart enough NOT to let the movement tag itself as crackpots.

Title 18. Section 1036

§ 1036. Entry by false pretenses to any real property, vessel, or aircraft of the United States or secure area of any airport or seaport
How Current is This?
(a) Whoever, by any fraud or false pretense, enters or attempts to enter—
(1) any real property belonging in whole or in part to, or leased by, the United States;
(2) any vessel or aircraft belonging in whole or in part to, or leased by, the United States;
(3) any secure or restricted area of any seaport, designated as secure in an approved security plan, as required under section 70103 of title 46, United States Code, and the rules and regulations promulgated under that section; or
(4) any secure area of any airport,
shall be punished as provided in subsection (b) of this section.
(b) The punishment for an offense under subsection (a) of this section is—
(1) a fine under this title or imprisonment for not more than 10 years, or both, if the offense is committed with the intent to commit a felony; or
(2) a fine under this title or imprisonment for not more than 6 months, or both, in any other case.
(c) As used in this section—
(1) the term “secure area” means an area access to which is restricted by the airport authority, captain of the seaport, or a public agency; and
(2) the term “airport” has the meaning given such term in section 47102 of title 49.

If the intent was to commit a crime the government has a solid case otherwise it’s a political prosecution if they follow through. I look for them to drop the case because they have already tried the case in the media with the help of their friends in the MSM.
