"Facilitating another’s intent to commit a crime is also a crime. If you know someone intends to break the law and you help them plan and organize it, you’re considered an accomplice."

You can either be charged as an accomplice to the principle, or as a co-conspirator if the state is building a conspiracy case.

O’Keefe and Giles were also sued in MD by ACORN and, IIRC, the State’s Attorney General, for taping on private property or some such. Also, various news reporters have been arrested over the years for violating federal law when testing airport security.

We should wait to see what the explanation is. The ‘press’ has a great deal of leeway not afforded the rest of us. I hope O’Keefe and his friends weren’t stupid enough to walk into illegal activity.

Yes. He has a bull’s eye on his back. Shall we see if this event makes the alphabet news? I can’t watch, but I wouldn’t anyway.

He’s a good kid, doing the work that the DOJ ought to be doing, but it’s completely political and corrupt under Holder.

re: That is correct, and I'm sure that is one of the charges that DC prosecutors are evaluating.)))

!!! That's it. They're going to take the fifth. This is definitely theatre.

"That would be "false pretenses". At the same time not much of a crime ~ $15 bond maybe."

That's not accurate. 18 USC 1036 comes with a penalty up to 10 years in prison, assuming you've made entry with the intent to commit a felony. It seems that thus far, this is the avenue that the prosecution is pursuing. If the state can't prove felonious intent, then it is just a slap on the wrist.

I believe this is political theatre.

You have the Obama administration giving 3 different numerical figures about the US employment/unemployment last Sunday on the political talk show circuit. You have Robert Gibbs stating the obvious absurdity that the Massachusettes [sic] Senator-elect Brown's election victory was a win for Obama. Anything coming from the Obama administration should never be taken at face value.

I agree and I think we should take this with a pinch thus far until more details come up.

The media will do the white house and ACORNS work and I think we all can believe that.

if he did do it then he is stupid and why anyway,I mean he gets to hear conversations and then what , he must be dumb to say that he got this info because he wiretapped or he got this info and then others would ask how

Asking to use the toilet and then not using it is just the sort of crime the federal judiciary loves to send folks to prison for (/not).

BTW, sometimes you think you have to go to the toilet, but then you find out you were wrong.

No crime in that.

A bathroom isn't a closet containing telephone equipment. No one taps toilets.

But, since you seem to be hung-up on toilets, I suspect if you were dressed as a plumber and asked to gain access to the building's plumbing systems, and it turns out you really aren't a plumber, you might be in a little bit of trouble. This would be especially true if the government thought and could prove you had some nefarious intentions for the plumbing.

Something's just not kosher with this story.

I agree. If you are going to do something illegal are you really going to record it on a cell phone? I dont think so. They were up to something, but not wiretapping.

Alas, all the "telephone equipment" is kept securely within the perimeter of the office environment, and not out there in an open wire room in the hall, or down in the basement.

Still, your lack of interest in the old "restroom excuse" suggests you have little sense of how people try to evade federal building security systems.

I’m going to say that everything worked according to O’Keefe’s plan. He was probably testing something.

I think it HIGHLY unlikely that they were trying to tap anything. O'Keefe might be brash and a little "showy", he doesn't strike me as a complete idiot. I think what is more likely is that they were trying to show how easily it could be done, which is why O'Keefe was there in street clothes, probably trying to tape the "sting".

Having said that, it was still stupid, as even if they had the best intentions, they probably violated the letter of the law. And, it's not like they've made any friends in this administration. I suspect after the government has made O'Keefe and his friends spend a considerable amount of money in legal fees, this will just eventually all go away.

It doesn’t make sense that O’Keefe would risk so much to wiretap one Senator who we already know is corrupt. There is WAY MORE to this story.

I’ll have to read more about this when I have more time..just breezed through the comments at this point. But one question came immediately to mind...who knew he was there that day..could it be that this guy was being tracked, at that they knew that was his plan, so waited for him to show up and nabbed him?

This is dissapointing...We have not come to the point (yet)where we feel we have no choice but to break the laws to save our country. (or have we?)
