More details emerge on Target's probe of immigrant workers
Contra Costa Times ^ | 12/17/9 | Matt O'Brien

WALNUT CREEK — Almost a month after an internal probe pushed 50 immigrant workers out of their jobs at a downtown Target store, interviews with former and current store employees portray a mass firing that was selective, planned in advance and confusing to many of those forced out.

Sparked by an allegation that illegal immigrants worked on the night shift, the Walnut Creek store last month attracted the attention of the Minneapolis corporate headquarters of the 1,700-store chain. The company sent a team to investigate, according to several people close to the incident.

By the end of the second week of November, 50 Latino employees — at least half of whom say they were given no warning of what was coming — were out of their jobs. It was not a layoff, Target said last week.

Nor did the 50 employees quit, said Rocio Avila of the San Francisco-based legal advocacy group La Raza Centro Legal, which has intervened on their behalf.

But whether the Latino workers were fired, or were otherwise compelled to leave on their own because they did not have the proper documents, remains a point of contention. Target says the store questioned some workers in mid-November about their eligibility to work in the United States, prompting most of those workers to voluntarily resign. It will not say any more than that.

Target was complying with the law, unlike their illegal immigrant employees.

If you can't show proper documentation, you're gone. Period.

You were saying ...

It sounds like what they did is present the facts of the matter to the employees (one by one) and then said to them, that if they have documentation then they need to bring it in -- or else -- the company would pursue the matter further with the authorities.

BUT, if they left on their own, the company would drop any further "investigation" into their matter... LOL...

I'm betting they all left on their own... :-)

It sounds like an "inside job" -- so to speak. In other words, Employee A says that he has a cousin who is looking for work. Now, they've got A and B. Then B says he's got two friends that live next door that are looking for a job. They've got A, B, C, and D now. Then all of them recommend about five more each, and now they've getting close to about 50 or more... LOL..

I’d say that an HR rep or two should be numbers 51 and 52.

Well, I hate to say it, but if you don’t hire illegal aliens in the first place, then you won’t have problems firing them.

Is it Target policy to hire carloads of illegal aliens, or was it just this one store? If it was just this store, then maybe they should consider firing the managers responsible, if they violated company policy.

No, we don’t need scapegoats. But we do need to stop hiring illegals in the first place, especially at a time when a fifth of the American work force is out of work.

In the original stories about this, it was stated that some of these illegal aliens had been employed by Target for SIXTEEN YEARS.

I'm betting they all left on their own.

Reminds me of one of my all time favorite Reagan (or any) quotes. When some media @$$wipe asked him why he fired all the air traffic controllers, he responded "It's illegal for them to go on strike. They went on strike. Looks like they quit to me." I still chuckle at that one.

"It was not a layoff, Target said last week. Nor did the 50 employees quit, said Rocio Avila ...".

Lets see, either they were fired on the spot or they were transfered to a Target store in Maricopa County, AZ and Sheriff Joe was waiting on them.

Close but not quite. Something very similar happened at my wifes place of employment. It came to Management's attention that certain 'identifying information' (read SS numbers) didn't match the names the employees gave.

The employees were given 30 days to 'clear this matter up' or their employment would be terminated due to Federal laws covering these issues.

Some of the employees in question did indeed clear things up. Most couldn't and voluntarily left rather than deal with the Feds.

However the employer had no choice but to do this. Federal law is quite clear. It's illegal to knowingly employ people who don't have proper documentation and companies face large fines for doing so.

Target is completely in the right here.

Not meant as a criticism of your post, just wanted to be clear.

Best,

L

I understand... but if the employee leaves, then the employer doesn’t follow through with it, do they? I don’t think so...

And thus, it would be clear that for the ones who cannot clear it up, they will leave on their own...

Of course the ones who can clear it up, there’s no reason for them to leave and why would they?

So, even with it being a requirement on the employer to follow through with the employee while they are there, I don’t think they’re required to follow through once they’re gone... is that right? :-)

One medium sized company in San Diego, that I do business with, has a lot of hispanic workers. All very helpful, but they also have a notice in the retail show room that they are participants in E-Verify. I guess some people have recently ask and they seem to have just posted the notice.
You might start asking your suppliers if they participate.
