Editors Note: In December ‘08 a retired CIA officer commissioned an investigator to look into the Barack Obama birth certificate and eligibility issue. On July 21, 2009 westernjournalism.com obtained a copy of the investigator’s report. Here is an unedited version of the report.
The Territorial Public Health Statistics Act in the 1955 Revised Laws of Hawaii
I think that I now understand the legal background to the question of where Obama was born.
Let’s begin with the statement that Dr. Chiyome Fukino, the Director of the Hawaii Department of Health released on October 31, 2008. The television and print media used this statement as a reason to prevent and treat with contempt any investigation into whether Barack Obama was not born in Hawaii. But the language of the statement was so carefully hedged and guarded that it should have had the opposite effect.
“There have been numerous requests for Sen. Barack Hussein Obama’s official birth certificate. State law (Hawai‘i Revised Statutes §338-18) prohibits the release of a certified birth certificate to persons who do not have a tangible interest in the vital record. Therefore, I as Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawai‘i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures.”
It is understandable that after such an apparently definitive statement most news outlets, whether conservative or liberal, would accept this as sufficient grounds to relegate the controversy to the status of a fringe phenomenon. Unless they happened to take the trouble to look into the “state policies and procedures” as laid down by the relevant statutes. If they had done so, they would have seen that Dr. Fukino’s press release was carefully hedged and “lawyered” and practically worthless. But the media in general should not be faulted. The statement seems to roll out with such bureaucratic certainty and final authority. I believed it to be significant until a Honolulu attorney mailed me the relevant statutes. I was so surprised that I laughed out loud.

I’ve thought all along that Obama was not born in the US. I think too, that he knows he is not a natural born citizen and eligible to run for the presidency.
I believe that once elected, he figured the matter would be taken up by the house and senate where there is a majority and this would somehow be rectified for him.
The main reason why we are finally being heard on this, and BTW Ann Coulter, I’m a physician and do not consider myself some way out kook conspiracy nut cake, is because the man’s negatives are increasing.

Someone should ask Gibbs tomorrow about the birth certificate.

There is a entry in a newspaper announcing BO’s birth. This had to come from someone at a hospital and is convincing proof that he was born in the US.

as Hawaii had a legal process to certify numerous types of births either witnessed within Hawaii, or stamped approved based on all sorts of other scenerios, it would appear to me that had Dunham applied for a birth certificate under Hawaii laws, regardless of where Zer0 was lying in his manger at birth;
Hawaii would have declared him an American citizen, given full rights as a citizen at birth, and therefore as a citizen “with birth record in the US,” he probably has rights to call himself a “natural born citizen”.
I haven't yet read his whole article yet, but I recall the Hawaiian DOH had investigation guidelines if fraud was suspected. If Obama's parent(s) lied, his "citizenship" status is in jeopardy.
Yes, I saw that. He’s got almost all of it right, but he made two big errors: Hawaii does not issue a document called a Certificate of Live Birth that looks just like the Certification of Live Birth. It IS the Certification of Live Birth that this family has.
Many people have freely substituted Certificate and Certification, so it is never clear what is the actual documet cited.
But the biggest blunder of all is calling Factcheck “reputable.” How can I get the memo to him that Factcheck is an Obama propaganda tool and co-forger of OBama’s COLB.
Here’s the thing: OBama and his lapdog media lie 100% of the time, 24/7, and they don;t care if Factcheck calls them out on half of them, because it means they validated half of his lies.
That’s the weakest argument in this whole debate(although the Obots keep frantically using it all over the internet out of desperation). Anyone can(typically grandparents) put birth announcements in their local papers. My grandparents put one in their city when I was born in another city and lived hundreds of miles away.
The newspaper announcement proves nothing.
Especially when it is pointed out that there is no independent verification that Obama’s parents EVER lived at the address cited, which is in an exclusive area.
Lessee, a rich area, where a young student mom and a Kenyan student with no job just happen to live.

Yeah, but after reading some of the article “lied” is a very subjective issue, as it appears anything goes.
It appears that if a non-resident can get someone to walk away from the pineapple fields within one-year, and sign an X on the spot, the kid is considered born in the state!

Yeah I know. We’ve gone over all the ways you could get a Hawaiian birth certificate over the last year on FR, which this ex-CIA office has just learned. I would hope Hawaii has kept the supporting documents for those cases where some one from the pineapple fields X’s his mark and instant citizen.... So we can follow the illicit trails.
