Well.., you see... that’s where you start going all wrong... LOL... You simply have never followed my posts when I was asking for it to be shown before the election.... :-)
And furthermore, another problem that I see people run into here, and what I have posted as the *big loophole* that is in the Constitution, is that it says that one has to be qualified (per its stated requirements) but there is nothing requiring *exactly what* is required in order to prove it.
And so, the *big loophole* that anyone can take advantage of, is what all the candidates have done all along, in the prior Presidential elections — which is to simply swear and sign paperwork that says you are qualified. And that’s it.
The simple fact of the matter is that Obama has already sworn that he is qualified per the Constitution.
And that’s precisely why that *big loophole* in the Constitution needs to be closed up, as I was saying by passing the state laws to that effect.
He’ll be in the Oval Office, feet on the desk, taking a nap, picking his nose, all Obama laws rescinded, and the country starting to do well all by itself.

The 20th amendment details what would happen if the President is found to be inelligible to hold office.
According to the Constitution, Biden would act as President until somebody was declared eligible. That “somebody” could be Biden or Pelosi or Hillary or...? In the end, it would be up to congress to find “somebody” to fill the post.

Does anyone have a list of instruction/laws implementing Article II, Section 1, Clause 5 of the Constitution regarding qualifications for President.
I have done some research for South Carolina and the wording on the Secretary of State’s site seems to ,at least partly, depend on the Party to ensure candidate qualification. There is nothing about what should be submitted to substantiate that the candidate is qualified.... seems to be sort of an honor code for people without honor. I also remember (December I believe) a statement from the SOS ‘s office that they were considering asking for proof of Sen. Obama’s eligibility.... don’t remember anything else about it.
It seems that the Federal Election Commission would be other agency responsible for verifying qualifications for the candidate, but I seem to recall (on a Lou Dobbs thread) that they did not do this.
I would think the role of the court in this would be two foal, are policies in place to implement the requirements for candidacy and were these policies adhered to. If either/or both were not accomplished then the Court should implement a remedy.

Yes. I fully understand the loophole. I think many people were shocked to learn that not a single state required proof, nor the FEC. So that is why you and “the birthers” agree it should be remedied with legislation, state or federal. And it will eventually.
But that does address the case of Obama, who has been challenged for many, many months prior to the election to prove his NBC status. The best we got was a COLB on Kos/FactCheck/FTS.
The difference is that you have accepted that as legit. Most conservatives have not.
So those “birther” conservatives have brought a multitude of lawsuits, have pressed their congresscritters (do you think ANY movement for verification laws would be in the works if a large segment of conservatives were not up in arms over this?), and are forcing it into the public conversation.
Yet you and others prefer to poo-poo it as being beneath common sense. Well, common sense tells me Hussein is a lying sack of shiite. Common sense tells me that he hasn’t released squat for his college records. Common sense tells me Bill Ayers co-wrote “Dreams”.
