Soldier balks at deploying; says Obama isn’t president

U.S. Army Maj. Stefan Frederick Cook, set to deploy to Afghanistan, says he shouldn’t have to go. His reason? Barack Obama was never eligible to be president because he wasn’t born in the United States. Actually, Obama was born in Hawaii in 1961, two years after it became a state. Cook’s lawyer, Orly Taitz, who has also challenged the legitimacy of Obama’s presidency in other courts, filed a request last week in federal court seeking a temporary restraining order and status as a conscientious objector for his client. In the 20-page document — filed July 8 with the U.S. District Court for the Middle District of Georgia — the California-based Taitz asks the court to consider granting his client’s request based upon Cook’s belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces. Cook further states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.” Cook, a reservist, received the orders mobilizing him to active duty on June 9. According to this document, which accompanies Cook’s July 8 application for a temporary restraining order, he has been ordered to report to MacDill Air Force Base in Tampa, Fla., on Wednesday. From there, the Florida resident would go to Fort Benning before deploying overseas. A hearing to discuss Cook’s requests will take place in federal court here Thursday at 9:30 a.m.

I demand the military defend the constitution and the freedom and liberty it describes...

We need to inundate her in-box with a request for some journalistic proof of this statement. But since she doesn’t even care to know the sex of the attorney bringing the action I’m sure she is just another clueless Obama-kissing “journalist”. Let her hear from us !!

The objective of the US military is not to preserver order, or the continuity of government. The objective of the US military is to, ABOVE ALL else, defend the constitution against all enemies foreign and DOMESTIC. If that means b—ch slapping the f-— out of all three branches of government if all 3 branches are skull f-—ing the constitution, then its the miltaries sworn oath to DO SO in a timely and smart manner.

I was wrong to say that nobody is doing anything. Probably, very few, would have been a better choice of words.

This is a high profile case, that hopefully, the media can't sweep under the rug. They hate the military & may go very public with this story, thinking they will disgrace the Major.

Just giving him a discharge, was if he were an enlisted man. Of course there are differences with him being an officer, that is my point. This would probably be dealt with differently if he were an E-2or3. I agree that his options for dissent are limited.

Your reply tells me you are too emotionally attached to the argument to understand the obvious. There were many that didn't believe Bush was a legitimate CIC but thankfully performed their duty honorably.

You are absolutely right. Once the citizens have done their Constitutional duty and elected the President it is the duty of every service member to follow his orders. Unless Maj Cook has concrete proof of Obama's illegitimate claim to qulification for office he is duty bound to follow orders.

Apples and Oranges. We are not talking about disagreement in policies and parties but the LAW. It is something called the Constitution of the United States of America. If you don't get that point, then you had better study before making any more comparisons.

Barack Hussein Obama born August 4, 1961 is the 44th and current President of the United States and CIC until the Supreme Court or Congress says otherwise. But go ahead and cheer this Major on in the destruction of his military career if it makes you feel better.

“I (insert name), having been appointed a (insert rank) in the U.S. Army under the conditions indicated in this document, do accept such appointment and do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic, that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter, so help me God.”

I completely disagree with the sentiment behind THIS comment...

“You are an Army Officer and its time to do your duty.”

You don’t have a clue about the real duty and responsibility an officer in this military was entrusted with. Just because most disregard their oath does not make those who show loyalty to the constitution anything other than faithful to their oath.

AND there you have hit upon the primary thing that neuters men who should be protecting this nation from the marxist revolutionaries who are currently raping it and the constitution.

Indeed. The military recognizes "legitimate avenues of dissent", and the ultimate trump for a commissioned officer is resignation. I suspect that, without definitive proof of Obama's legitimacy, this would be MAJ Cook's optimum course of action, and it may yet come to that. I don't think it's MAJ Cook's point to protest the order or policy, but merely to ensure that he's not placing himself in legal/moral/ethical jeopardy by following an order that he suspects may not be legal, and consequently he's merely looking for clarification of that at this point.

The Major also has a responsibility to his unit and his troops. His claim has yet to be proven, so he should sack up be responsible. He’s leaving his troops high and dry.

I would have a hard time with a guy like this as my wingman.

A few people have suggested the soldier do his dity and serve. I thought his duty was to uphold The Constitution against foreign AND domestic enemies?

If some is an usurper who is not eligible and gained office through FRAUD and is a ineligible person - are they not violating The Constitution?

I loath Obama just as much as the next guy but if I were given orders today with his name on it I would serve.
