It was a reversal - not a remand, therefore, I think the firefighters won ... they get their promotions.

OK, you got me: I don't understand your post. "Merlin" is local dialect for Maryland in what we call the Tidewater region, which is pronounced "Tahdwutter" in Maryland and "Tahdwalwtuh" in Virginia. But what is Absurdistan; and what is MOM?

About the affirmative action pressures of teaching: I taught college sophomores quite some time ago -- in the 80s; even then, when I gave a "D" to a very talented student who was clearly goofing off and underperforming, who was also a person of color, the Dean called me in and ordered me to change the grade, which I refused to do. I explained to the girl and to the Dean that she was abundantly talented and her attendance and work were very poor and she needed a butt kicking now before she tried to slide all the way through school underperforming. Fortunately for the student, I won; she ended up at the top of her class senior year. She and her parents both thanked me at graduation.

Today, I would have been placed on Administrative Leave from the get-go.

I appreciate very much your having taken the time to write your essay above. When FR began, it was during the Clinton years, and people were so grateful for a place to lay out their thoughts and outrage. During the past 8 years, when the apparent balance of power shifted, things started to slide into little but one-liners. If only people had kept up the thought and development! Lately, however, I've been seeing long posts again, and it's about time. I hope it's not too late.

In an attempt to illustrate how institutional racism can sneak into the performance analysis, they cite that access to study materials is not uniform across racial lines, because most minority firefighters are first generation firefighters and have no kin network over which study materials and assistance can be provided.

And how is this different than any other profession? If my father is a good blacksmith, doctor, etc. then chances are, I will learn to be a good blacksmith, doctor, etc.

If I'm first in my generation to go into a profession, of course I will need to put more initiative into studying for that profession. That's life, and the way things have been since civilation existed.

They cite that, in conjunction with the reported multi-week backorder for ...

Blah blah blah blah blah...

All of the above mumbo-jumbo falls like a house of cards if just one black candidate passes the test, or in fact, any candidate that doesn't fit that template passes.

You don't need a "kin" network, just a desire to study and learn.

What does this mean? Remanded back to the ultra-leftist Circuit judge who first rejected the claims? Or does the ruling order they must get their promotions? this is a BIG DEAL. The left in CT is saying if the case is sent back, the firefighter will likely never get their promotions, and they will hold up the process forever.

Usually "remand" is a housecleaning measure. The Second Circuit will remand this case to the District Court which originally heard the case. That court will hear any new motions in light of this decision. For example, expect these firefighters to request a writ of mandamus to force the certifying of that test and the granting of their promotions (maybe even back pay).

Do liberals do this because they know Whites are more competent? Or is it because they only expect a Black to be equivalent to 3/5ths of a White?

It would seem that their low expectations for Blacks should be offensive to all people.

Sotomayor says: He can't help it he scored poorly on the test, he's just a negro. Give him credit for outscoring the chimpanzee. You can't expect him to compete on an even level with humans.

Honest minorities should be infuriated with attempts to “soften the blow of racism” by using yet more racism.

For some it's the same old power hungry concept, basic to human nature, that is fueling the new racism and the rise a new class of blind selfishness.

The political pendulum never stops in the middle where peace can be found. A European style elitist political class can keep themselves in power without appearing to dictate by playing both sides of the revenge and by keeping the fires burning on at least one side or the other. This is how our oligarchy is surviving with it's thin veil of democracy. It's deception.
