Sessions says he’d consider gay Supreme Court nominee

Sen. Jeff Sessions (Ala.), the ranking Republican on the Senate Judiciary Committee, said Wednesday he could consider a gay nominee for the nation’s highest court.

“I’m not inclined to think that’s an automatic disqualification,” Sessions said of a gay nominee. He said he intends to consider only the nominee’s legal judgment when deciding his support for Justice David Souter’s proposed replacement.

“I may disagree with some legal opinion on those issues, but I think fundamentally it will be up to the president to submit somebody who would unite the country and would be a clear statement of a mainstream judge who commits himself to the law,” said Sessions, who will have a key role in any confirmation debate.

Sessions’s comments weren’t voiced universally in the GOP or in conservative circles Wednesday, suggesting a split among Republicans on whether the sexual orientation of a nominee should be a factor.

One Republican senator on Wednesday warned a gay nominee would be too polarizing.

If the nominee were a strict constuctionist in the image of Thomas or Scalia, then I really don’t care who they sleep with.

Like Levin said tonight, referring to whether or not a woman should be chosen: (paraphrasing) "Its not what's between their legs that should make the difference, it's what's between their ears!"

The part you quoted was not really representative of the content of the article.

Sen DeMint's comments pretty well sum up all of the comments within the article:

Sen. Jim DeMint (R-S.C.) also wouldn’t rule out the possibility of a gay nominee, though he said Obama should avoid nominating someone based on ethnic or social profiling. “He should just focus on a proven judge who understands the Constitution and has demonstrated a willingness to support the rule of law,” DeMint said. “I hope this does not turn into some kind of ethnic profiling or social profiling, that it’s got to be a woman or a black or something other. That doesn’t make any sense to me.”

And I can live with that position.

I don’t care whether a justice is white, black , male, female, tall ,short, straight, gay or any other label that is used by leftists to divide us and treat us like members of groups instead of true individuals with God-given talents. What I care about are the nominee’s qualifications, temperament, and views. Sounds like Sessions feels the same way.

Odds are we’ve already had an alcoholic Justice, a drug addicted Justice and yes, even a gay Justice. People of all political stipes have issues. GW Bush is an alcoholic. Rush Limbaugh is a drug addict. And even reasonable Republicans can be gay. How does one’s sexual orientation preclude them from proper jurisprudence?

Not what I meant but I could have been clearer, that was a separate comment altogether... I was wondering if we the people, could file a class action law suit against 535 idiots plus POTUS for violation of the constitution period. They violate everything it stands for for and don’t understand the basic principles.

The thought of gay supreme court justice is just sick to begin with...

It is of no consequence what the ranking Republican on Judiciary thinks.

Obama has at least 70-75 votes in the Senate to do whatever he wants with regard to judicial nominees.

Only 3 Republicans voted against Ginsberg, for heaven's sake.

Sessions is totally wrong. An avowed homosexual judge by definition has their values system screwed up.

I believe Sessions to be wrong unless it's a misdirection. He is totally wrong with his thrust. He should have said: What difference does it make what I think? I may as well go bowling when the 'hearings' come to pass. The Democrats will be choosing the next Justice. Go ask them.

He is entirely intimidated.

The MSM/DNC/Hollywood/Academia war room wins again.

Exactly. I imagine most people on here would say that the nominee should be picked based on credentials and their past decisions and not on color or gender (or their empathy for certain groups). Sessions says that he is not going to disqualify someone based on something not related to their jurisprudence and he is crucified for it. This is what we want from the other side.

The democrats are trying to divide us and they are doing a great job doing it. Sessions gave a very wise answer.

Given that Sessions is likely to oppose any liberal judge (one would think), this comment is merely and affirmation on his part of homosexuality.

And, the Republicans wonder why they have been destroyed in the past two election cycles. They keep driving conservatives out of the party with actions like this.

Gay or not is irrelevant! Has the candidate ever read the constitution? Do they believe it is as accurate today as when it was written, plus amendments? Will they agree to defend it and use it as the ultimate source of the law and freedom? Will they not allow foreign courts to influence their decisions?

There is no chance any Obama nominee is going to believe that. Sessions knows that. So, his comment ends up being merely an affirmation of homosexuality.
