Exactly. If we’re going to take a hit, might as well take it where it will do the most good and least damage.
For example, if aliens came by and said “The bad news is that we have to hit your country with a 5 megaton nuclear weapon. The good news is you get to pick where,” the correct answer is “Please detonate it out in the middle of the desert in New Mexico, we even have a nice marker for you to use as a target.”

WTF!!! Does not even begin to cover this. Did anyone really think about the unintended consequences of closing Gitmo and this move? Which is more important satisfying a small percentage of one's own voting block or the security of a whole nation?

Excuse me, why are we endeavoring to “discover” that the Gitmo trials are illegal? In the case of the Cole this was a US military vessel attacked by foreigners in the Middle East. Are you aware of some requirement that the military hand these guys over to, say, a civilian criminal court in New York?
The entire exercise is unecessary except to a liberal meddler (Obama).

In politics, perception is reality.
There really is no reason to delay any of the trials. 0bama is playing to his base. While bitching about the long detention of these terrorists, he has just added 4 months additional to their stay, delaying justice even further. The DU and Kos Kids are all thrilled about it. Dumb!
They will eventually be tried, in one court or another. He would not dare release them otherwise.

Adding to your posit, how far down the line of presidential succession is the Secretary of State? I mean, most of the folks in the Obamanistration are from her (husband's) administration anyway VP (Biden), Speaker of the House (Pelosi), President Pro Tempore of the Senate (Robert Byrd), SOS Her Heinous. Biden has had two serious incidents of brain aneurysms and Robert Byrd is 400 years old, but Nancy would fight to the death and, except for being overwhelmingly stupid, is otherwise healthy as far as we know.
Most likely scenario IMO is Biden makes Hillary his VP. Remember one of his gaffes when he told all of us she was fully qualified to be VP even President and that she just might have been a better VP pick than himself...
