Not sad I think that way. Sad that it’s true, but it has always, always been true. The law always is what the vast majority of people are willing to obey. The rest may be letters on a page, but it ain’t the law unless the vast majority are willing to uphold it.
Leo mentions on his web site that he had more time to help Cort with his case so it may be a better case. He also said Cort’s case was cleaner in CT lower courts. The judge in NJ’s lower courts changed the paperwork after the fact to try to derail Leo’s case. Leo is not sure if this harmed his case but obviously that the was th NJ judges intent.
There may also be some hope becase Scalia has Cort’s case and apears to be carefully reviewing it. I am not saying Thomas did not review Leo’s but Leo has detected some differences in the way it may have been handled by the clerks or something.

Considering the USSC refused to give hearing and verify that most basic requirement of any candidate for POTUS, the Court, “with a deafening silence,” stated thus: the United States Constitution is officially dead. No person in this nation has legal standing to challenge anything about anyone. The precepts written in the Constitution mean only whatever men want those words to mean at the time and for their own convenience.
We are now a nation governed by the whims of men, and not by immutable law. Under such bondage, any policy, Barak Obama effects as president, will stand indisputable, because those having the courage and resources to make challenge will come against an impenetrable wall of indifference, even at the highest levels of authority.
Those citizens, whom we imagined made of sterner metal, will prove themselves kowtowing poltroons, offering the convenient excuse we must work in the system an arrangement they know no longer exists, though they are unwilling to state such openly. Men will suffer every conceivable infringement and insult to their liberties, so long as such is sufferable. To preserve fleeting material treasure, to hold their vain imagining of security, they will gladly sell their fellows into bondage. I opine such individuals are fools.

You raise a valid point: Roe v. Wade, contrary to what most Freepers might think, is a classic example of the fact that regardless of what the USSC says the constitution says, Americans get what they want: most Americans favor some access to early abortion; a much larger majority favor strong restrictions in the second and third trimester. A no man’s land has emerged in which most of the victories on either side are at the margin-—executive orders about military basis, PBA, and so on. So you have a network of laws, regardless of what the constitution says, that elevates a right to privacy above some people’s right to life, and so far that has been perfectly acceptable to the large majority.

Again, I'm not saying it's real or fake, only that what I've seen is speculation rather than anything approaching proof. My larger concern is that this issue is in reality only a technicality, and one that threatens to distract us in the same manner that the whole "Bush Stole The Election/Selected-Not-Elected" meme consumed the Democrats for more than four years.

I like the platform of the American Independent Party. Now, would its leadership in the future be wowed by DC social acceptance or would they actually have the stones to stand up for said platform???
I would only remind others of the following:
1. The supremes did not rule on the merits.
2. SCOTUS is not infallible and has made unconstitutional ruling before.
3. There other cases that still have potential.
4. If BHO is ever proven to be a natural born citizen, all of us who demanded proof would not be losers, but we and the nation would be winners because we made sure that the constitution was abided by.
5. If BHO is found not to be eligible, even 3 years form now, he must be removed from office. He would be illegitimate and no one, including the military, would be legally able to take orders from him. I also believe that Biden would be an illegitimate successor. As nauseating as it is to think, Peolsi (if she is still around) would be next in line. However, I think that the only proper work around would be to install Pelosi as interim president until the congress as constituted at the time of the 2008 election, can reconvene to elect a new president. Of course the SCOTUS would most likely have to get involved...that is if anyone if the federal government has shred of patriotism left in them.
..or BHO can come clean and settle the matter one way or another right now...but that would take patriotism, ethics, concern for the nation and honesty...he is incabable of any of these.

You are correct. If you look at the docket, you will see that Donofrio never actually filed a petition for a writ of certiorari, but apparently instead through correspondence asked that the emergency writ be also treated as the cert petition.

Obama filed NO papers in Donofrio, or Wrotnowski, or Martin, or any of the other cases, at least so far. Those cases were brought against state officials, not against Obama.
