Supreme Court to Uphold or Ignore the Constitution?
Capitol Hill ^ | Dec. 7, 2008 | JB Williams

Posted on 12/07/2008 11:14:58 AM PST by PlainOleAmerican

As of this writing, December 6th, the Supreme Court has not yet announced whether or not it will take up the Donofrio case, or any other case concerning Obama’s constitutional eligibility for the office of President.

Yet there is no more important issue before the court today and the clock is ticking.

(snip)

The Supreme Court of the United States of America has but one primary obligation to the American people, and that obligation is to use the power afforded it under Article III—Section I of the Constitution, to uphold, protect and preserve the U.S. Constitution, the Charters of Freedom, and provide equal justice for all, without regard to personal political leanings or ambitions…

Would prefer to have these cases tried by the SCOTUS not the MSM or talk radio....They are much too important. Glad they have all chosen to keep quiet....and not add fuel to the upcoming fire.

"Would include those who send their kids to public schools? :D"

In my view, yes, QED. But I have to acknowledge and appreciate that a few, very few, may have no choice.. or honestly believe they do not. But the rest? Absolutely.

wa cannot possibly be a natural born citizen of the USA in the traditional legal meaning of that term

The "traditional legal meaning," as outlined in common law textbooks and in several US Supreme Court decisions, is equivalent to "native-born" or "citizen at birth."

There are only two categories of US citizens, natural-born and naturalized.

If Obama was born in HI, he's natural-born.

If he was born elsewhere, the issue gets complicated, but he may still be eligible.

I am temporarily going to play devils advocate here.

The SCOTUS will pass this up on several levels, first off because of the major disruptive issues that will entail afterward”s. First off would be the fact that every issue, nominee and position given out by Obama would have to be nullified, this cannot happen, a rotten potato has been placed under a massive pile of other potatoes and looking for and finding the rotten one will only damage the rest.
So in the eyes of the courts they do not want to damage the pile.

Another aspect of why this case will go nowhere is that if they did eventually find because of Obamas dual citizenship that future political candidates running for ANY office must follow those guidelines of natural borne unless they knew that at a later stage like the governor of California they could never be nominated for presidency, in Obamas case he probably never thought he had a chance to get where he is now and thus surfed on what credentials he did have which were enough until certain groups saw him as the answer to their prayers and moved him further up with massive cash influxed over several years with the manipulation of the MSM to promote his position towards becoming POTUS..

So they cannot enforce the requirements of the Constitution because it would require a complete overhaul of the election system making it too honest and fair, it would backtrack to too many offices and lawsuits about eligibility factors.

And then of course is the fear factor that they are afraid of flaming cities of deranged supporters running amok and challenging authorities. They are also afraid of past skeletons coming out of closets possibly their very own.

Obama will become President because he has studied for years all the loopholes of getting the Presidency, in effect he has become the ultimate lawyer using words and twisted facts that the jury can only believe because if they questioned anything it would mean years of sequestering and nobody wants that.

“Where are the coward conservative talk show hosts?”

I stopped listening to Rush on Thursday after over 18 years for this very reason. Of course Sean and the rest made my do not listen to again list.

Agreed, this is the right case for them to take up, from those I’ve seen.

If they don’t, I too have a major problem with them!

Don’t you think if this issue had merit, talk radio would be all over it? Come on-take off the tinfoil hat.

If some can ignore the constitution on areas they disagree on can the rest of us ignore the part concerning the collection of TAXES?

Actually, I think the current interpretation of the constitution is just that...if your mother is a citizen at time of your birth, then you are a natural born citizen. But when obama was born, they were more strict about who they gave “natural born” status too.

I could be wrong though.

He has produced a birth certificate...the state of Hawaii won’t provide such proof because of the privacy laws. Hello-you know how every time you go to a new doctor you have to sign a privacy law form acknowledging you were told about privacy laws?

Don’t you think talk radio would at least mention it without taking sides since it’s at the supreme court? And since there are so many lawsuits? Regardless whether it has merit or not?

Come on. Think about it. take off your dunce hat.

I have thought about this issue and why I am completely against these lawsuits etc. I tried to understand why. I am not an Obama fan so why? I thought about it and came to this conclusion. In a Democracy or Republic you have elections. Someone wins and someone loses. We lost. Part of our greatness is the peaceful transfer of power...we have to hop for the sake of the country the new guy does a good job. It’s the American way. Trying to overturn an election and waging multiple, expensive useless lawsuits is wrong. It makes us look like moonbats and sore losers.

Hello?

Don’t you know all obama has to do is sign a form to give permission to see the proof?

Don’t tell me some idiotic “privacy law” meant for health reccords trumps the constitution.

Not entirely true Sherman...

Obama was a citizen of Indonesia until at least the age of 21 at Occidental college, when he traveled abroad under his Indonesian passport.

No matter where he was born, which is indeed in dispute, there is NO dispute over the fact that he was a citizen of Indonesia at a time when Indonesia did not allow dual citizenship.

This means he had to have renounced his citizenship in any other nation in order to become a legal citizen of Indonesia.

If he had “naturalized” upon returning to the USA, (which he didn't), then he would be a “naturalized” citizen, not a natural born citizen today.

Please know the facts before posting.

He has provided a copy online. I saw it with my own eyes. I would not be in favor of giving multiple people copies of my birth certificate...it a private document and can be used for all kind of bad things.
