Obamas Birth Certificate Challenger Keeps Going
You've got to hand it to Philip J. Berg: he doesn't give up easily. You might recall that Philadelphia attorney Berg tried, and failed, to halt the presidential election of Barack Obama on the grounds that he is not a native-born citizen. Game over, right? Wrong.
Berg filed a writ of certiorari to the U.S. Supreme Court in late October, asking that the highest court review the decision of the U.S. District Court in Pennsylvania. The latter court dismissed Berg's claims because he lacked standing to bring them. Standing requires plaintiffs to prove they are directly affected by the issue at hand, with evidence of injury that is concrete and particular. In its decision the district court said Berg "does not, and we believe cannot, establish injury in fact." It also dismissed his claims as frivolous.

Some folks like to delude themselves. This is a wild goose chase. Were there more meat and were it so easy to show as many on here have tricked themselves into believing, I can’t imagine the Clintonites wouldn’t have played this card long ago. Or maybe they are in on the giant conspiracy to hide his origins too. The conspiracy that only some bright internet gumshoes have been able to get wind of.

Now I doubt that anything can overturn the election result, I do think there are some issues that should be looked at.

On balance I think conservatives ought to countenance this effort. First, sometime during Obama's administration it might just become apparent that he is not constitutionally entitled to the office and it is better to have laid the predicate now. If Obama embarks on a very serious effort to move the country dramatically to the left, the argument over his constitutional qualification, in effect over his legitimacy for the office, will make his more radical positions seem even more radical and perhaps less supported by the populace.
Second, I am not unaware of the weight of the law which is profoundly against Berg's position on the standing issue. Nevertheless, something within me screams out, how can there not be standing for a citizen who has his vote stolen by a fraudulent nominee, when the law does backflips to protect the rights of minorities to have their precious votes counted? Which contemplates the greater harm? Finally, if there is no remedy for a legitimate question which goes to the very heart of the government's legitimacy, you no longer have the rule of law. A democracy cannot long endure if it abides such an anomaly.
A house divided against itself cannot stand
What concerns me is the aftermath of either decision. Whichever way it goes, a lot of people will be thrilled and I fear the celebrations might get out of hand.
So they will probably rule somewhere in between and there go the celebrations!
