McCain would not be removed because he does qualify constitutionally. That was already discussed at great length at during the primary season. Remember McCain’s birth certificate being all over the news? That is when Obama was then forced to put his up.....but of course it was the fake one he put up on his web site that had been put up on KOS.
It was very smart of Leo to include McCain in his complaint as no one could say he was just after “the one”!
I will check Hannity’s message boards tonight to see if Leo was able to get it to Justice Thomas. It is a joke that every state does not check candidates for President.
Many jobs check far more and a legitimate birth certificate is usually a minimum. If we do not make a stand here then we are a third world country.

This case isn’t about birth certificates. It is about the candidates being certified and not being vetted. I would think it nulls everything, no?
McCain is a US citizen, but he is foreign-born. He is not natural-born.
It’s past time to stop making excuses for McCain on this and throw him under the bus.
Barry Obomber was born in Kenya but his bio-parents were Anne Dunham and Frank Marshall Davis, both Americans.
That’s why Obomber co-sponsored that ridiculous “sense of the Senate” resolution illegaly “declaring” McCain eligible for the Presidency.
Because their status is the same.
This New Jersey suit is the only one recognizing this so far.

But in order for all candidates to be constitutionally certified, wouldn’t they have to show a birth certificate if there was ANY QUESTION as to where they were born?
Yes, but that isn’t what I’m trying to ask. I know I’m not doing a good job of it.
If the candidates weren’t certified, the election has to be a do over, right? That also means the primaries weren’t valid because unqualified candidates changed the landscape of te electoral process.
I think the fact that there were 3 different variations of foreign born situations on the ballots show that there was intent to challenge the natural born status.

I see 3 Presidential candidates on my ballot that aren’t listed at the FEC site. How can you run and not file?
I think we need an entire do over. Bill all the parties that dropped the ball.
The information below was posted by Mr. Donofrio this morning, 11/12/08, on democratic-disaster.com. So far his case is still in limbo at the SC clerk’s office, and is not being presented to Justice Thomas. Mr. Donofrio is requesting interested parties call the SC, or directly write Justice Thomas.

The US Supreme Court Docket fails to mention the NJ Supreme Court decision and that is completely wrong and improper. This case continues to be subjected to Judicial/Clerical misconduct and it’s time that US Citizens, be they Democrat, Republican or 3rd party affiliated, stand up and order that the Clerk’s office of the highest Court in the land STOP interfering in a case that is rightly before the US Supreme Court.
This is unprecedented in that the Clerk’s office at the SCOTUS appears to be injecting politics into the handling of paperwork properly before it. It will be a terrible blow to the separation of powers if Supreme Court review can be stopped by Clerks imposing their own political views on litigants who have properly followed legal procedure.
I call on all US citizens today to call both the Clerk’s office and the Public affairs office and to complain about the way this case has been handled. Please call them.

Careful what we wish for: there have been unqualifed candidates on every ballot for 200 years, probably, if SCOTUS overturns this election, it'd have to overturn every one.
I'm ~happy with Biden over Obama.
But not Pelosi, for some reason.

Thats what SCOTUS is there for - taking the Constitution, the law, the concept of “original intent”, and common sense to hammer out the isssues arising from flaws in the Constitution.
Sometimes they get it right, sometimes not.
These were decided without clear stiipulation from the Constitution:
Gideon v. Wainwright (right to counsel)
Miranda v. Arizona (rights must be read to suspects)
United States v. Nixon (limits on executive privilege)
Roe v. Wade (implied right to privacy)
In this case, the Founding Fathers CLEARLY DID NOT WANT a non natural born POTUS AND they WOULD have demanded Obama’s Birth Certificate (”original intent” and common sense).

Obama is more than non natural born. He is financially tied to Auchi. Auchi conspired and helped overthrow Iraq. that is how we got Saddam.
We can’t bend rules for enemy combatants.

It’s just that the SCOTUS ruled on a local case about 10 years ago. The local PD arrested a soccer mom on the field for having her child look for a lost toy at 3mph with the door open and out of seatbelt on private property.
She took it all the way to the USSC, whose opinion was ‘well, we really find for you but we’d have to reverse every ticket like yours in the country, which would be too cumbersome, so no thanks’.

This is an outrage that SCOTUS clerks and SCOTUS are giving Mr. Donofrio a run around. One of the conervative talk show hosts needs to mention this.
Maybe Grassfire, Newsmax or another group can doo an email blast to get their priority letters sent to Justice Thomas or all teh Justices. They have a priority mail system where people can pay to get it mailed to all.
I really do not think there would be another election. I have never heard of a ANT question concerning a candidate's constitutional qualifications until Arnold ran for Governor of CA. Then it was cleared that he could run for Governor, but he could never run for President. There is really no question on the qualifications of Biden or Sarah, but just McCain and Obama.
Guess we will hear before January 20th if the Presidential qualifications stated in the Constitution actually matter and will be verified.
It is more than just getting Obama out though. It is securing our electoral process.
Never forget, when the Iraqi’s had their election, a suicide bomber showed up. An Iraqi Policeman bear hugged him and dragged him out. He blew himself up to secure their long awaited right to vote.
Our process has been terrorized. He have to bear hug it and take it back. Not settle.
Believe all letters sent to Justice Thomas and Chief Justice Roberts need to be sent by certified mail with return/receipt requested! Otherwise, what is to stop a Clerk from making sure our letters enter the circular file?
