II Findings
Finding Number One
October 10, 2008
Vol. One - Public Report
For the reasons explained in section IV of this report, I find that Governor Sarah
Palin abused her power by violating Alaska Statute 39.52.11O(a) of the Alaska Executive
Branch Ethics Act. Alaska Statute 39.52.11O(a) provides
“The legislature reaffirms that each public officer holds office as a
public trust, and any effort to benefit a personal or financial interest
through official action is a violation of that trust.”
Finding Number Two
I find that, although Walt Monegan’s refusal to fire Trooper Michael Wooten was
not the sole reason he was fired by Governor Sarah Palin, it was likely a contributing
factor to his termination as Commissioner of Public Safety. In spite of that, Governor
Palin’s firing of Commissioner Monegan was a proper and lawful exercise of her
constitutional and statutory authority to hire and fire executive branch department heads.
Finding Number Three
Harbor Adjustment Service of Anchorage, and its owner Ms. Murleen Wilkes,
handled Trooper Michael Wooten’s workers’ compensation claim properly and in the
normal course of business like any other claim processed by Harbor Adjustment Service
and Ms. Wilkes. Further, Trooper Wooten received all the workers’ compensation
benefits to which he was entitled.
Finding Number Four
The Attorney General’s office has failed to substantially comply with my August 6,
2008 written request to Governor Sarah Palin for information about the case in the
form of emails.
MSNBC is doing a breaking news segment on it now blasting her of course.
Um how can you abuse power if you break no law? Isnt abuse of power defined by the law?

Just heard a Fox News radio blurb saying that the “ethics report” was a “blow” to Palin and that she fired the Service Direcotr because of a family dispute, not a budget one.
So of course I came straight here to find out the FACTS.

At least this will take the focus off of McCain saying Obama’s a decent family man and we have nothing to be scared about.

The citizen suit raised doubts about Branchflowers neutrality, citing public statements from the investigators Project Director Democratic Sen. Hollis French.
French, who is actively supporting Barack Obamas presidential candidacy, handpicked Branchflower to conduct an investigation to determine whether Alaskan Governor Sarah Palin violated ethics rules in firing Public Safety Commissioner Walt Monegan. French has publicly said he expects Branchflowers inquiry to culminate in an October surprise that would hurt Palins chances of becoming vice president in November.
Their suit specifically detailed an exchange Branchflower had with Alaskan lawmakers during a Senate Judiciary Committee hearing last Friday. Branchflower admitted that not only did Senator French actually remove a name from Branchflowers subpoena list, but that he was not sure why French had done that, their suit said. When asked specifically about the removal of the name, Branchflower stated that he would have to defer that question to Mr. French, thus admitting that the investigation was under the de facto control and direction of Senator French.
