Also, I would like to see ICE follow up on this situation with both the employee and the employer.
But what kind of people are running this company?
The injured illegal worked for them for "about 15 years"!
Then he sustains an on-the-job injury and they deny him any kind of coverage!
He shouldn't have been here and they shouldn't have hired him but their actions are despicable.
They wanted to saddle taxpayers with his medical and (since he cannot work) his living expenses as well.
They all belong in jail.
Agree !
BTTT !
who would want to be injured at work and not have medical expenses paid for?
the company should not have hired him to begin with.
Exactly.
The quickest way to cut back on hiring of illegal aliens is to simply disallow deduction of wages paid to employees without a valid SSN and proof of residency. You want to hire illegals? Go for it - you’re using after-tax dollars, though...
This should be a warning not just to employers of illegals but also to property owners hiring these type companies. If the illegal so chooses he can sue the owner of the property they were working at. Always make sure contractors working on your property are not only licensed and bonded, but also carry workmens comp
Of course the slave master, er I mean employer should pay. They should add triple damages to be paid towards the ICE budget, just to send a message to all employers: don’t hire illegals.
Sun Valley Landscapes argued that because Andrade is an illegal immigrant, he was not covered by workers’ compensation benefits.
So, his employer thought he was dependable, hardworking, honest, reliable, agreeable and lastly, disposable.
I don’t agree with the hiring folks who are here illegally, but I side with the worker and for that matter, the taxpayers. The employer’s obligation is to carry Workmen’s Comp. Wonder how much money the employer saved not covering the employee.
The guy *presumably* hired him, looking the other way on the immigration status, as a cost-cutting measure.
So you can't argue, "Nope, I didn't mean to hire him, and besides, lookatthis, he's -- gasp -- illegal. I'm shocked, Shocked, I tell you."
Cheers!
That is what slave labor is all about!
This is an astonishing -- and utterly depraved -- argument for the company to make AFTER HE WORKED FOR THEM FOR 15 YEARS.
Workers like this guy are being exploited and the employer should take the financial hit. No sympathy here.
That's one of the reasons they hire illegals in the first place.
The illegal should be deported and the employer should be fined big time and have to send the injured worker his checks to Mexico.
Excellent Observation
“Wonder how much money the employer saved not covering the employee.”
Landscaping business, the business saved a lot of money. I don’t know workers comp but I’d guess he saved 10-20% of the guys salary.
I agree. But once having hired him, I do believe that they owed him at least his workman’s comp.
This is one of those cases where I feel that the worker, even though he is ILLEGAL deserves some help: proper medical care, his pay and then be deported, everything paid for by the EMPLOYER! Then the owner for the company must be made to PAY and PAY and PAY because this man can no longer work!
Must really suck when that cheap labor stops being so cheap. LOL
“The quickest way to cut back on hiring of illegal aliens is to simply disallow deduction of wages paid to employees without a valid SSN and proof of residency.”
That’s a very good idea.
