This should be a warning not just to employers of illegals but also to property owners hiring these type companies. If the illegal so chooses he can sue the owner of the property they were working at. Always make sure contractors working on your property are not only licensed and bonded, but also carry workmens comp

I don’t agree with the hiring folks who are here illegally, but I side with the worker and for that matter, the taxpayers. The employer’s obligation is to carry Workmen’s Comp. Wonder how much money the employer saved not covering the employee.

I know a orthopedist in Dallas that recently preformed knee replacement surgery on a man from Mexico. The patient had injured his knee earlier when a cow had kicked him. His employer in Mexico paid cash for the surgery.....

Send him home, and let the employer pay the bills there. If Home is Mexico, they certainly will be a lot less than in the southern suburbs of Omaha.

I agree with the ruling. I don’t see what documentation the employee used to be hired therefore I will not hold the employer responsible for hiring him. I don’t want employers being immigration cops anymore than I want employers to be bookkeepers for the government. The government can verify the documentation or change the laws. I think employers should show total cost of employment so workers can see what is actually taken from their actual pay.
I adjusted WC claims for almost 5 years in California and had similar situations. The illegals sometimes come here planning to file a claim and take their settlement back to Mexico where the money goes a lot farther. I had some SSNs come back with 10 or more names tied to it from all over the country. I turned claimants and employers in for fraud with no results. I had video of an illegal working for a different employer and an idiot judge ruled that the claimant credibly testified that it wasn’t him in the video! I had depositions from several claimants that the employer paid them under the table. This reduced the premium and is employer fraud. The whole system is corrupt.
