ARLINGTON, VA-- U.S. Senator John McCain today issued the following statement regarding today's United States Supreme Court ruling on District of Columbia v. Heller:
"Today's decision is a landmark victory for Second Amendment freedom in the United States. For this first time in the history of our Republic, the U.S. Supreme Court affirmed that the Second Amendment right to keep and bear arms was and is an individual right as intended by our Founding Fathers. I applaud this decision as well as the overturning of the District of Columbia's ban on handguns and limitations on the ability to use firearms for self-defense.
Unlike Senator Obama, who refused to join me in signing a bipartisan amicus brief, I was pleased to express my support and call for the ruling issued today. Today's ruling in District of Columbia v. Heller makes clear that other municipalities like Chicago that have banned handguns have infringed on the constitutional rights of Americans. Unlike the elitist view that believes Americans cling to guns out of bitterness, today's ruling recognizes that gun ownership is a fundamental right- sacred, just as the right to free speech and assembly.
This ruling does not mark the end of our struggle against those who seek to limit the rights of law-abiding citizens. We must always remain vigilant in defense of our freedoms. But today, the Supreme Court ended forever the specious argument that the Second Amendment did not confer an individual right to keep and bear arms.

Oooh, good analysis, hadn’t thought of it that way. It seems Obama isn’t able to keep his head low enough on this though. He’s gone on record as being against gun ownership so even though it’s “off the table” it’s still an issue fresh in our minds because of this case. It might be able to have a little bit of impact for at least the current election, but in general I agree with your take.
I wish he hadn't said that, because it's incorrect and distracts from an otherwise great smackdown.
There are still unconstitutional limitations on CCL carry in many states. Specifically in NYS many jurisdictions (counties) give the issuing judges the ability to restrict the CCL to "taget and hunting" and do not allow it for general self-defense. I hope that gets settled now in NYS.

Let's read Miller in light of Heller.

Heller clearly opens the door for a challenge to Chicago’s ban. The Second Amendment foundation has a lawsuit challenging the Chicago ban ready to go.
Heller is a first step in a process. There will be victories and defeats for our rights, but this is a step in the right direction.
If nothing else, Heller puts second amendment issues in the forefront during this election cycle. The second amendment is no friend to Obama (and vice versa). He is an aggressive anti-gunner which will hurt him in much of the country.
Pleasure to see that this older combat veteran still has a load of testosterone on board!

MacCain can (and will) say anything with conviction in a speech. That's part of his problem.
Don't be too surprised if you ever see him meeting with Jim Dobson on Sunday and at SF's gay day parade in full biker wear the following Saturday.
I don't think it's incorrect at all. Keeping in mind the Court's current MO that the 14th Amendment incorporates enumerated rights, I think it's entirely accurate to say the decision "makes clear" such bans are unconstitutional, even if it doesn't expressly state it.
At the rate he's growing into a "Main Street" conservative, he'll have been already dead twenty years before he's acceptable to most.
And, BTW, at his age he doesn't have enough time to "grow" into the job.

However, I find it difficult to believe he would not take advantage of the opportunity to pander to his new constituency....
Incorporation’s an obvious future step, but it hasn’t happened yet, and McCain’s stating otherwise is just wrong (not that he actually writes his own press releases, but someone jumped the gun here).
Due to this statement, I think I might vote McCain.....depending on what he proposes to do/not do to build on this decision.....
...he ain’t the only option out there (and voting for Obama is NOT an option)....
