Heller clearly opens the door for a challenge to Chicago’s ban. The Second Amendment foundation has a lawsuit challenging the Chicago ban ready to go.
Heller is a first step in a process. There will be victories and defeats for our rights, but this is a step in the right direction.
If nothing else, Heller puts second amendment issues in the forefront during this election cycle. The second amendment is no friend to Obama (and vice versa). He is an aggressive anti-gunner which will hurt him in much of the country.
I don't think it's incorrect at all. Keeping in mind the Court's current MO that the 14th Amendment incorporates enumerated rights, I think it's entirely accurate to say the decision "makes clear" such bans are unconstitutional, even if it doesn't expressly state it.
