WASHINGTON (CNN) -- The Supreme Court ruled Wednesday that executing a Louisiana child rapist would be unconstitutional, concluding capital punishment is reserved for murderers.
The ruling was a 5-4 decision.

“The ruling stemmed from the case of Patrick Kennedy, who was sentenced to death in 2003 for raping his 8-year-old stepdaughter.”
He WAS sentenced to death and now they protect the rapist. Disgusting!
We can no longer execute for treason, spying or desertion?
Death penalty for child rape is a bad idea but it’s certainly a state issue.
There are only a few options remaining when the citizens can no longer trust the government to enact justice.
No surprise...only that it was that close.
Accidents can always happen.
Kennedy no longer deserves respect. Regardless of what one thinks of having the death penalty for child rape, it is absurd to claim that it violates the 8th Amendment. “Justice” Kennedy is a disgrace. Hope he’ll be off the Court soon.
This ruling has me extremely distressed and upset, I need to calm down, what should I do? I am wondering what planet do these Justices, that ruled in favor of striking down this law - live on? Do they have children or grandchildren? Are they that divorced from reality? Unjust punishment? What about what is done to the child? They are scarred forever. The mutants that do things like this to defenseless children, I am sorry to say this, God forgive me, they deserve to be evaporated from this society./Just Asking - seoul62........
Sounds like CA’s 9th district.
Are you joking? Why on Earth would you think that the Alito, Thomas, Scalia, and Roberts would support such an awful decision?
5-4 decision.
Another reason to vote for McCain...yecch—like taking out the garbage somebody has to do it.
How about forcing the father and criminal into the same cell for an hour??? Pay no attention to the baseball bat ....

Jessica Lunsford’s Dad Blasts Mass. Pol’s Vow to ‘Rip Apart’ Child Rape Victims at Trial
Wednesday, June 25, 2008
The father of a Florida girl abducted and buried alive in a trash bag by a sex offender has blasted a Massachusetts politician who said he’d have to torment young victims on the witness stand if mandatory sentences for offenders passed the state Legislature.
...
Fagan came under fire last month for remarks he made about young victims during a debate in the Massachusetts House on the state adopting Jessica’s Law, which would require a mandatory 20-year sentence for the rape of a child under age 12.
“I’m gonna rip them apart,” Fagan said of young victims. “I’m going to make sure that the rest of their life is ruined, that when theyre 8 years old, they throw up; when theyre 12 years old, they wont sleep; when theyre 19 years old, theyll have nightmares and theyll never have a relationship with anybody.

How about forcing the father and criminal into the same cell for an hour??? Pay no attention to the baseball bat ....
The Supreme Court keeps on handing the GOP issues.
Take advantage of it.
This ruling will result in people taking the law into their hands, including cops shooting the guy if they catch him red-handed, or fathers going after the guy after he is indicted but out on bail.
We used to hang perverts in this country and had few perverts. Now we have so many that we need public lists of who they are and where they live.
...and yet many informed people remain who would stay at home and help elect a president that would place members on this court that makes this version look conservative.
