Court: Texas had no right to take polygamists' kids 3 minutes ago

SAN ANGELO, Texas - A state appellate court has ruled that child welfare officials had no right to seize more than 400 children living at a polygamist sect's ranch.

The Third Court of Appeals in Austin ruled that the grounds for removing the children were "legally and factually insufficient" under Texas law. They did not immediately order the return of the children.

Child welfare officials removed the children on the grounds that the sect pushed underage girls into marriage and sex and trained boys to become future perpetrators.

The appellate court ruled the chaotic hearing held last month did not demonstrate the children were in any immediate danger, the only measure of taking children from their homes without court proceedings.

Well, things haven’t changed much.

Though most are trying their best to maintain civility.

It seems the threads start off with domination by one ‘side’ , then the other, then it kinda mellows out into decent debate.

Ouch. So that would leave the men still at the farm, the wives and kids pretty much where they started.

You just have to shake your head and wonder if more than three minutes worth of contemplation took place before the initial raids.

My next prediction is that some CPS, local prosecutors and law inforcement officials are going to be looking for new jobs.

There might also be some charges coming down the pike based on improper actions also.

Great. The worst possible tactics and outcome for the children has been masterminded by the CPS and local authorites.

What a fiasco.

We gotta start marking people by tattoos and other things so we can convict people without trial, without proof, without due process. It makes approved religious zealots happy when we eviscerate those that are unapproved. We can use the civil courts to circumvent individual liberty.

We need to get these kids normal. Lets teach them to be gay and that it's OK and introduce to T/V and video games

Point well taken here but..... It is the vile forces at work that are trying to destroy the old fashioned family. Sneering at June Cleaver and "Father Knows Best". A battle that is being fought day to day. I would venture that does not describe the majority of American families. Who do not relish the sad Britney Spears. Sadly, I agree that there is a risk inherent in life and living at any period in history.

Are the fathers irresponsible lazy bastards who use the state to support their offspring? Yup. Should all the men who took an underage "wife" go to jail? You bet 'cha.

.....that all men are created equal,that they are endowed by their creator with certain unalienable Rights, that among these are Life,Liberty and the pursuit of Happiness.

This includes women and children.

Heck, I have even been on the phone with major news organizations over their mischaracterizations in the past (they rarely make the mistake anymore, so I'm not so busy these days, thanks to the current conflict).

I checked that thread out, and it was sad to go back over the accusations leveled at those who predicted what is taking place now could very likely be the end result. None of them were happy to see kids abused, but wanted things done right. Well, kudos to those who championed CPS, local DA and law enforcement actions here. They wound up supporting what now appears like a complete collapse of the case.

I’m not sure where this will end now, but it doesn’t look good for real justice for the real culprits.

I don’t know if that’s true. I know that I wish that every allegation was false, because that would mean none of the girls had been forced to get married. But I rather doubt the entire thing is made up.

It is scary. If you disagree with the actions of the state of TX in this situation, you love or are a child rapist or you hate your government and have a conspiratorial view. People forget that government will run amok if the people it serves do not keep it in check. Healthy skepticism of the state is necessary to protect our basic rights.
