University Professor and Tennessee Company Charged with Arms Export Violations
KNOXVILLE, TN A federal grand jury in the Eastern District of Tennessee returned an 18-count indictment today charging J. Reece Roth, a Professor Emeritus at The University of Tennessee, and Atmospheric Glow Technologies Inc. (AGT), a Knoxville-based technology company, with conspiring to defraud the U.S. Air Force and disclose restricted U.S. military data about Unmanned Aerial Vehicles (UAVs), or drones, to foreign nationals without first obtaining the required U.S. government license or approval.
The indictment was announced today by James R. Dedrick, U.S. Attorney for the Eastern District of Tennessee, and Patrick Rowan, Acting Assistant Attorney General for National Security. Roth, age 70, currently resides in Knoxville, Tennessee. He is anticipated to make his initial court appearance next week before a U.S. Magistrate Judge.
Roth is charged in the indictment with one count of conspiracy to defraud the U.S. Air Force and violate the Arms Export Control Act; 15 counts of violating the Arms Export Control Act, and one count of wire fraud for defrauding the University of Tennessee. AGT is charged in the indictment with one count of conspiracy to defraud the U.S. Air Force and violate the Arms Export Control Act and 10 counts of violating the Arms Export Control Act.
According to the indictment, between January 2004 and May 2006, Roth and AGT engaged in a conspiracy to defraud the U.S. Air Force and transmit export-controlled technical data related to a restricted U.S. Air Force contract to develop plasma actuators for a munitions-type UAV, or drone, to one or more foreign nationals, including a citizen from the Peoples Republic of China. The Chinese national was a graduate research assistant at the University of Tennessee. The University of Tennessee was victimized by the conspirators and cooperated throughout with the Federal Bureau of Investigation (FBI) led federal investigation.
Further, according to the indictment, Roth departed for the Peoples Republic of China in May 2006 and carried multiple documents, which were subject to export controls, containing technical data controlled by the International Trafficking in Arms Regulations and related to the above U.S. Air Force contract.
The indictment also alleges that, in May 2006, Roth directed the wire transmission to an individual in China of a document containing restricted technical data controlled by the International Trafficking in Arms Regulations and related to the above contract.
Violations of the Arms Export Control Act carry a maximum possible penalty of ten years imprisonment and a $1,000,000 fine. Wire fraud carries a maximum possible penalty of 20 years imprisonment and a $250,000 fine, while conspiracy carries a maximum penalty of five years imprisonment and a 250,000 fine.
United States Attorney Russ Dedrick said, The protection of United States technology is a continuing priority of the Department of Justice and this District.
Whenever restricted U.S. military data is illegally disclosed to foreign nationals, Americas security is put at risk. Todays indictment demonstrates just how seriously we view such violations, said Assistant Attorney General Rowan.
These investigations were jointly conducted by the Federal Bureau of Investigation, U.S. Immigration and Customs Enforcement, U.S. Air Force Office of Special Investigations, and the Department of Commerce Office of Export Enforcement. The case is being prosecuted by Assistant U.S. Attorneys Jeffrey Theodore and Will Mackie of the United States Attorneys Office for the Eastern District of Tennessee.

Local citizens, SOI lead to 19 caches discoveries in 16 days

SAMARRA, Iraq Sons of Iraq and local citizens have provided information leading to 19 weapons, explosives and bomb-making caches being found by Iraqi Security and Coalition forces during the first 16 days of May.
The cache items included approximately 100 artillery and mortar rounds, approximately 100 white phosphorous grenades, more than a thousand pounds of homemade explosives, detonation cord, and numerous improvised explosive parts and important documents.
Al-Qaeda in Iraq used Samarra as a sanctuary previously. Today, AQI has no support from the local population, said Capt. James Leidenberg, a spokesman for the 1st Brigade Combat Team, 101st Airborne Division. Citizens of the city are taking advantage of the initiatives to provide safe neighborhoods by removing caches within Samarra.
The ISF and CF have spent several months building safe neighborhoods for Samarra including establishing walled communities with limited access. The Samarra Operations Center is another example. It provides a multi-representative security force, which jointly protects the city.
Samarra is becoming an example of what can happen with individuals dedicated to the well-being of their fellow countrymen, said Capt. Josh Kurtzman, a company commander in the 1st Brigade Combat Team, 101st Airborne Division. We have National Police working hand in hand with Sons of Iraq and local police and a Kurdish Iraqi Army Battalion. Samarra has become an example for the rest of Iraq.

Citizens lead Soldiers to three caches (Kalsu)

FORWARD OPERATING BASE KALSU, Iraq Local citizens led Multi-Nation Division Center Soldiers to three separate caches locations, May 16.
The area was once a haven for criminal activity.
Local Iraqis are tired of the violence and fighting and have come to see the benefits of assisting the Coalition and (Iraqi Armys) efforts in their community, said Lt. Col. R.J. Lillibridge, a 2nd Brigade Combat Team, 3rd Infantry Division spokesman. The benefits of assisting the Coalition and Government of Iraq clearly outweigh any benefit to supporting or tolerating the insurgency.
The first cache consisted of four rocket-propelled grenades, six RPG warheads and six RPG boosters.
The second cache contained 100 belt-linked rounds of 7.62 ammunition, 250 loose pistol rounds, SKS magazines, AK-47 magazines, AK-47 butt stocks, bayonets, flasks of gunpowder, a couple spools of wire and a rifle with bayonet.
The third cache contained 500 rounds of 9 mm ammunition and 1,000 rounds of PKC machine-gun ammunition.
The three caches were discovered within a five-kilometer radius of each other and the contents were taken to a local patrol base for disposal. All items were secured by an explosive ordnance disposal team. Over the past week, MND-C Soldiers have removed 13 caches from the area.
The recovery and removal of these caches from the area helps to continue the ever-increasing security and stability in the area, as it removes the opportunity or potential to attack Coalition and IA forces from the area, Lillibridge said.

Iraqi Army finds large cache in support of Operation Lions Roar

TIKRIT, Iraq The Iraqi Army found a large buried cache during clearing operations in support of Operation Lions Roar in the Younis al-Sabawi neighborhood of Mosul May 19.
The cache consisted of more than 100 mortar rounds, more than 100 mortar fuses, two mortar tubes, two mortar bipods, one suicide vest, two rockets and eight mines.
The explosives and weapons were likely to be used against Coalition forces, Iraqi Security Forces and Iraqi citizens. As the enemy continues to flee, continued operations show the enemy that the ISF and CF will continue to disrupt their operations until they run out of resources, said Maj. Peggy Kageleiry, spokesperson for Multi-National Division - North.

MND-B, Iraqi Army Soldiers find weapons cache, IEDs
Multi-National Division Baghdad
BAGHDAD Iraqi Security Forces and Multi-National Division Baghdad Soldiers discovered a munitions cache and several improvised-explosive devices May 20 in Baghdad.
In the Hadar area of East Rashid, Iraqi army Soldiers from the 11th Iraqi Army Division acted on a tip from a citizen in the area and discovered four 82 mm mortar rounds and five 60 mm mortar rounds at approximately 3:45 p.m.
At approximately 5:40 p.m., Soldiers from the 107th Engineer Battalion, 2nd Stryker Cavalry Regiment, attached to 3rd Brigade Combat Team, 4th Infantry Division, found an explosively formed projectile and a deep-buried IED on the outskirts of Sadr City as Iraqi Army soldiers ventured inside of Sadr City while conducting Operation Peace.
At approximately 7 p.m., Soldiers from the 107th Engineer Battalion discovered four IEDs just outside Sadr City.
Soldiers from 4th Brigade Combat Team, 10th Mountain Division, found an EFP at approximately 8:20 p.m. in the Kamaliya area of New Baghdad while conducting a route-clearing mission.
Multi-National Division Baghdad Soldiers, along with their Iraqi Security Forces partners, are continuing to help rid the area of these dangerous weapons, said Col. Allen Batschelet, chief of staff, Multi-National Division Baghdad and the 4th Infantry Division. We remain vigilant in assisting the ISF in protecting the people of Iraq.

This Travel Warning updates information on the unsettled security situation in Somalia and continues to urge American citizens not to travel to the country. This supersedes the Travel Warning of November 13, 2007.
The Department of State warns U.S. citizens against all travel to Somalia, including the self-proclaimed Republic of Somaliland, since there is no U.S. Embassy or other U.S. diplomatic presence in Somalia. Consequently, the U.S. Government is not in a position to assist or effectively provide services to U.S. citizens in Somalia.
Kidnapping, murder, illegal roadblocks, banditry, and other violent incidents and threats to U.S. citizens and other foreigners can occur in many regions. Inter-clan and inter-factional fighting flares up with little warning. Unpredictable armed conflict among rival militias is prevalent in southern Somalia, particularly in and around Mogadishu, which has resulted in the deaths of hundreds of Somali nationals and the displacement of nearly one million people. In December 2006, Ethiopian military forces entered Somalia in support of the Somali Transitional Federal Government. The continuing Ethiopian military presence and support for the Transitional Federal Government has heightened tensions among rival political and clan factions within Somalia.
The Sanaag and Sool Regions in eastern Somaliland, bordering on Puntland (northeastern Somalia), are subject to insecurity due to ongoing border disputes and inter-clan fighting. There also have been several fatal attacks and violent kidnappings against international relief workers, including Westerners, throughout Somalia, Somaliland, and Puntland. Lines of control in Mogadishu are unclear and frequently shift, making movement within this area extremely hazardous. Violent riots have recently occurred in Mogadishu, as thousands of civilians protested rising food prices and the devaluation of the Somali currency.
Recently, insurgents and extremist elements opposed to the Somali government conducted hit-and-run attacks on several towns in central and southern Somalia, to include the districts of Gedo and Bay (especially the vicinity of Baidoa) in the south.
U.S. citizens also are urged to use extreme caution when sailing near the coast of Somalia. Merchant vessels, fishing boats, and recreational craft all risk seizure by pirates and having their crews held for ransom in the waters off the Horn of Africa, most especially in the international waters near Somalia. There have been numerous such incidents, highlighting the continuing danger of maritime travel near the Horn of Africa. If transit around the Horn of Africa is necessary, it is strongly recommended that vessels travel in convoys, and maintain good communications contact at all times.
U.S. citizens who travel to Somalia despite this Travel Warning are urged to register through the State Department’s travel registration website, https://travelregistration.state.gov and obtain updated information on travel and security from the U.S. Embassies in neighboring countries. Travelers to the self-declared Republic of Somaliland should register with the U.S. Embassy in Djibouti, and travelers to Puntland or southern Somalia should register with the U.S. Embassy in Nairobi.

ICE teams up with Palm Beach Sheriff’s Office to identify 182 foreign-born criminals detained
WEST PALM BEACH, Fla. - A ten day comprehensive effort by U.S. Immigration and Customs Enforcement (ICE) detention and removal officers and officers from the Palm Beach Sheriff’s Office yielded the identification of 182 foreign-born criminals for deportation.
The operation dubbed “Secure Shores”, which is part of ICE’s Criminal Alien Program, began on May 5 and culminated Friday. The focus of the program is on identifying criminal aliens who are incarcerated within federal, state and local facilities to ensure that they are placed into removal proceedings so that they are not released into the community upon the completion of their criminal case.
During this operation, ICE officers screened foreign-born nationals detained at the Palm Beach County jail to determine which individuals were eligible for deportation. Among those identified, was Elias Toledo-Nasario, of Mexico who was charged with sexual assault and Roy Kennedy Cunningham who was charged with premeditated murder.
ICE officers placed 157 criminal illegal aliens into deportation proceedings, identified 19 immigration fugitives and six who illegally re-entered after being deported.
“Whether on the street or in jail, foreign-born criminals should know that ICE will track you down and ensure that you don’t have another opportunity to hurt our law-abiding citizens, said Michael Rozos, ICE field office director for the Office of Detention and Removal in Florida. “We were glad to team up with PBSO in this great effort.”
Last year under CAP, ICE charged a record 164,000 aliens in law enforcement custody with immigration violations and deported approximately 95,000 aliens with criminal histories. ICE estimates that approximately 300,000 to 450,000 convicted criminal aliens who are removable are detained each year at federal, state and local prisons and jails.
