Tancredo Criticizes Bush Decision to Appeal Illegal Alien Murder Case
Congressional Web Site ^ | Oct. 9, '07 | Press Release

Posted on 10/11/2007 12:53:56 PM PDT by T.L.Sink

Rep. Tom Tancredo today criticized the decision by President Bush to allow an appeals case to move to the Supreme Court regarding an illegal alien who was convicted of gang-raping, sodomizing and murdering two 14 year old girls. "It's astonishing that this president would give into international pressure from the Mexican government and possibly set this convicted gang member free," Tancredo said. Jose Medellin confessed, along with a handful of other gang members, to gang raping, sodomizing and murdering two 14 year old girls. He even took a wristwatch from one of the girls as a souvenir. At issue is whether or not Medellin and the others were denied their right to contact the Mexican consulate prior to confessing their crimes. The International Court of Justice at the Hague ruled in favor of the Mexican government and asked the United States to reconsider their sentences. Concluded Tancredo, "If the decree of some international tribunal were to trump our judicial system it would be a national embarrassment."

So what does that have to do with the price of tea in China?

It has to do with something called "due process" which the Constiution guarantees to all persons.

You’re straining at gnats.

I hope you are never arrested on a felony charge abroad. It won't be straining at gnats for you then, I'll tell you.

Good for Tancredo. Bush’s action is outrageous.

By choosing to use the resources of the federal government and the power of the Executive Office of the President of the United States to lobby on the bahalf of convicted gang rapists and murderers in support of international courts and non-US laws to grant clemency for subhuman garbage, the President has once again disgraced his office, spit on the rule of law, trashed the US Constitution, rejected American sovereignty, and wiped his behind with the American flag by supporting and defending murdering filth and the supremacy of diseased, criminal coddling international socialist courts of the Eurabian Hauge against common decency, human morality, justice, and a sovereign American state of this country.

True, the acorn doesn’t fall far from the tree and George Bush Jr., RINO liberal quasi-socialist globalist is a chip off the old block of George Bush Sr., but worse. Every single thing conservatives worried about and warned against in nominating a “moderate” “centrist” like George W. Bush has come true in spades and the fielding of another liberal Republican globalist who looks to foreign courts for our law and legal precedents, will result in a Hillary Clinton Presidency because conservatives have had all they can stomach from continued and ingrained Republican Party establishment and leadership failures and betrayals and will either vote a third party or stay home.

After the Republican Party totally ignored and dismissed the conservative base in 2006 and was crushed as a result, you’d think they would have learned their lesson by now, but not so. The RNC’s eager backing of a nominee even more liberal and socialist than George W. Bush, Rudolph the Red-Nosed RINO, and their trashing of genuine, bona fide conservatives as “extremists” is testament to this fact. However, we have seen this before in 1992 and to some extent in 1996, when party hacks slandered and eschewed their conservative supporters and backed two candidates largely disliked by Reagan conservatives fed up with Republican concessions to Democrats and political moves to the left with incredibly disastrous results.

Tom Tancredo is among the few Republicans that make voting Republican worthwhile still. Yet he and the other so-called “second tier” candidates, slandered, smeared, mocked, ridiculed, and ignored by the liberal media as well as Republican party beltway establishment hacks, are the only hope of uniting conservatives and defeating another Clinton Presidency. However, the way things have been going, I think a lot of Republicans in power would be happy if Hillary Clinton were elected because then they resume their comfortable roles as subserviant, worthless back benchers promising relief but providing nothing but BS and hot air. That was all conservatives ever got until Ronald Reagan delivered us out of bondage. Where is our Reagan? He sure as hell isn’t in the current White House administration or the Republican “first tier”.

“...possibly set this convicted gang member free”

“I haven’t seen the ‘setting free part before? How does this play in?”

That’s why the Mexican national/llegal alien/convicted rapist-murderer went to the International court...to overturn a decision by an American court in order to be set free..back onto the American streets, and near your teenage daughters...

“The International Court of Justice at the Hague ruled in favor of the Mexican government and asked the United States to reconsider their sentences”

The IC needs to be dropped by the American Govt along with the UN...we are a sovereign country..no other country should be making decisions for We the People...

I have certainly heard of such arrests in Mexico. Off hand, I can’t name one. Here’s the advice given to USA travelers to Mexico from the US consular:

Arrests

1. US Laws DO NOT apply in Mexico. The American Citizen Services Unit cannot provide protection or remove you from jail. Nor can it act as your attorney.
2. The American Citizen Services Unit can visit you in jail and provide a list of lawyers without recommendations.
3. TheAmerican Citizen Services Unit will visit American prisoners to asses reasonable treatment - within the norms of Mexican jails, and where mistreatment is believed to have occurred, file a Protest.
4. Mexican Law is Napoleonic, and thus quite different than what US Citizens are used to. Mexican Law presumes you are guilty until proven innocent.
5. Advice: avoid problems with the Law. Especially avoid illegal drugs and people likely to be associated with drugs.

Everyone seems to be worried about what will happen if we don't abide by this "consular rights" argument. I have two questions: 1)What about all the hundreds (thousands) of illegals who get arrested every day right now? Does every one of them get to talk to someone from the Mexican embassy? Is that happening now? and 2) What happens if he does get a retrial because he didn't get to talk to someone at the embassy, and this gets out and makes big news. Every two bit little gang-bang punk that gets arrested will be wanting an embassy representative. There will be thousands of request per day. And then the embassy won't be able to handle them all. Or the perp will have to sit in jail for 2 weeks waiting for a consular rep. And then what will the police do? Knowing that they are going to have to hold someone for two weeks before they can even talk to them? Do you think that this won't be exploited to the max by every two bit Mexican hoodlum with an activist lawyer? In the end, the cops will just end up letting people go (or not arresting them) because they know that it will be almost impossible to get a conviction. We will be effectively giving the Mexicans veto power over our judicial system.

People are saying it's all about 'reciprocity'; what if one of our citizens get in trouble in Mexico. I think it's all about results. And the only results that I can see are the ones that I have outlined. For every one American citizen who might not be able to talk to an American consul, there will be 1000 Mexican punks that the police will not even bother to arrest because they know that the Mexicans will just blow them off for two or three weeks. That's what's going on right now with the ICE, the cops won't call them because they don't get any results. Sorry, but instead of going with the 'what if' argument, I'm going to go with my 'what probably' argument.

"just as the US hopes that US citizens arrested abroad will have their rights so honored. This case has implications for all US citizens abroad as well as for the war against terrorism. "

Just how will this reciprocity work in the absence of a treaty? The treaty in question has been RESCINDED by GWB! Bush apologists keep bringing up this reciprocity, but neglect to mention under which treaty.

Here’s how the rapist-murderer thinks about what he did...he seeks pen pals and doesnt have one remorseful thought about Jennifer and Elizabeth...

“JOSE ERNESTO MEDELLIN To Whom it may concern, My name is Jose E. Medellin, I am 25 years old. I was born March 4, 1975 in Nuevo Laredo,Mexico. I stand 5” 7 ft tall and I weigh 165 pounds. I have brown eyes and brown hair and I’m currently living on Texas’ death row. I am writing you this letter in hopes to find a pen pal and hopefully we can become friends. Some of my hobbies are reading, military history, drawing, writing, and exercising. That’s basically what I can do in here. I spend most of the day in my cell. Well let me tell you a bit more of myself. I was born in Mexico, but at the age of 9 years old I came to live with my parents in Houston. I went to school there till the tenth grade, after that I dropped out of school and went to work for a construction company till I was 18 years old. At that age is when I got arrested and a few months later I was sitting here on death row. I really hope this fact won’t discourage you from writing me and getting to know me better. If you are interested in corresponding with me, please write to me at the address below.”

That’s the mentality of the illegal alien who did heinious things to two innocent American teenagers, and was convicted for his crimes...

He “got arrested and a few months later (he) was sitting (there) on death row”...He is NOT sorry for what he did and has been duly sentenced to the death penalty...

Until that happens, Jennfer Ertman and her family and Elizabethe Pena and her family will not have justice...

I think that’s exactly right. The whole system would be so congested that law enforcement will just say why bother. Maybe that’s the motive of the illegal lobbyists.

Medellin needs to be retried with consular assistance. Nothing in a retrial would prevent him from being convicted and executed.

I've not seen in any report on this that he was denied consular access. We just didn't hold his hand and require the mexican consulate participate in the trial. This piece of human refuge just wants a 'do-over'  because he's facing the prospect of being given some measure of justice for his crime.

THere is a big difference between the two. If you can find evidence that he was denied access to consulate officials I'd be interested in seeing it. Otherwise, this is just typical NWO garbage.

My understanding is that the international court could recommend his release from U.S. custody on the technicality that he wasn’t advised of his rights. Sort of a “Miranda” for illegal aliens.

I’m glad you appreciate all the drama - especially that associated with the murders. Ames Holbrook has written a book which deals partly with the bogus issue of “reciprocity.” The point is that this isn’t an issue that should even fall within the purview of eiher the Supreme Court or an international court. The government of Mexico is the criminal accomplice of the criminal aliens by encouraging their invasion of the USA - even to the point of providing them with maps and interfering in American domestic politics.

I agree. Tancredo and Hunter are being ignored by the MSM because they tell the truth about all the special interest lobbies that are promoting the illegal invasion: The business groups (U.S.Chamber of Commerce, et al.) that love the cheap labor with no basic benefits; the ethnocentric lobby groups; the politicians pandering for their votes. On the other hand, Tancredo and Hunter are telling us about the cultural and economic ruin this has wrought: increasing taxes for prison incarceration, bankrupt school districts, the enormous human and economic costs of the drug cartel, insolvent hospitals, ever-rising social welfare costs. Of course, when confronted with facts the pro-illegals can only reply by name-calling: they play the race card and call those who want secure national borders xenophobes, nativists, and worse. The pro-illegal special interest groups really don’t give a damn about the welfare of the American worker or the middle class - or for that matter, the welfare of the nation. Tancredo and Hunter have the courage and fortitude to buck this huge coalition.

For the past 27 years the Clintons and Bushes have dominated American politics. And we may have another 8 years of the Clintons! If so, they’ve lasted far longer than many monarchies. Well, actually we may join Britain and become an official constitutional monarchy.

I like President Bush alot, but immigration is not his strong suit, I'm afraid.

What he OUGHT to do is hold this guy while Cheney strangles him, on live TV.

A very astute analysis! We do need someone who is Reaganesque and who will return the party to conservative core principles. I think Tancredo (who has a 96% rating with the American Conservative Union) and Hunter are the most authentic conservatives right now. Some poll watchers will say they’re not electable. But Reagan lost his first primary shot too!

I voted for Bush the first run but in the second I voted against Kerry. Sadly, Bush is no conservative. He’s cut taxes but failed to reduce spending; he’s refused to veto nearly every wasteful pork bill that’s come before him; he sponsored and signed the biggest entitlement (prescription drugs) since LBJ; he signed McCain/Feingold campaign finance reform which clearly violates the First Amendment; he waffled on affirmative action when it was before the Supreme Court; true, he’s made two good nominations to the Supreme Court but the second nomination was forced on him after the Harriet Miers debacle; and, in an age of international terrorism he’s failed to secure our borders - not to mention the cultural and economic ruin the illegal invasion has brought us. He’s governed as a moderate Democrat, not a Republican conservative.
