CNN: Flying Mexican Flag Over US Flag Is OK
NewsBusters.org ^ | Richard Newcomb

Posted on 10/03/2007 5:33:07 PM PDT by SandRat

A Mexican bar owner in Reno Nevada flew the Mexican flag above that of the United States. Only problem is that this is specifically illegal under United States Code Section 7, Title Four, which states,

(c) No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy. No person shall display the flag of the United Nations or any other national or international flag equal, above, or in a position of superior prominence or honor to, or in place of, the flag of the United States at any place within the United States or any Territory or possession thereof: Provided, That nothing in this section shall make unlawful the continuance of the practice heretofore followed of displaying the flag of the United Nations in a position of superior prominence or honor, and other national flags in positions of equal prominence or honor, with that of the flag of the United States at the headquarters of the United Nations.

The brazen effrontery of the bar prompted an American veteran to cut down both flags. But when CNN reported on the event, they managed to significantly skew the perception. The CNN report simply states that the veteran was angry that the Mexican flag was placed above that of the US- no mention was made that it was in fact illegal under US law. CNN compounded their offense by showing in their video clip, not the actual words of the relevant US code that outlaws this action, but instead 'flag rules' taken from USHistory.org, thus downplaying the actual offense, by suggesting that athe law is in fact merely recommended behavior. As in so much relating to the illegal alien lobby, apprently it is OK with CNN for immigrants to disrespect and/or disobey the laws of our country, but let one American try to react, and they scream bloody murder. Balance? What balance? Cross-posted on StoneHeads.

This is just an instruction to government offices how to display the flag.

It does not make it a criminal act for private individuals to act otherwise. If anyone claims it does, where is the penalty for violating this law specified?

This, while all the McDonald's in Reno NV hire nothing but illegal aliens...

Those in Reno ought to totally boycott that corporation.

I might be wrong but I really don’t think there is a United States anymore. I can’t find any obvious indications that the U.S. still exists. I think everyone has “globalized” themselves.

Since it is a crime, I wonder what the prescribed penalty for a violation is.

A private citizen can do about what he wants on his own property with any flag as far as I’m concerned.

The penalty?

You want a damn penalty?

Here's your penalty:

The United States of America is a sovereign nation.

We owe allegiance to no other country, no other flag.

I and many thousands of others like me, know damn well that we are a sovereign nation, owing allegiance to no other country.

Therefore, I and thousands of others like me, will not allow the Flag of the United States of America to be flown inferior to any other flag, in these United States.

I, for one, if I see it, I'll do the same damn thing the hero in the video did.

I'll rip the damn mex flag down, confiscate the Flag of the United States of America and dare the damn fool that displayed it to confront me.

I'm tired of this stinking pussy-footing around about this crap.

We are being invaded.

We are being invaded by a bunch of welfare leeches from a third world crap hole, said third world leeches thinking that they are the rightful occupants of our land.

I will not, I cannot stand and see the Flag of the United States of America flown inferior to any other flag.

I don't give a damn what flag it is, if it is flown superior to the Flag of the United States of America, I shall interpret it as an act of war and I will respond accordingly.

Is that enough penalty for you?

"Since it is a crime, I wonder what the prescribed penalty for a violation is."

From the Federal Law Relating to Display:

"Nature of Codification of Customs and Rules

The Flag Code is a codification of customs and rules established for the use of certain civilians and civilian groups. No penalty or punishment is specified in the Flag Code for display of the flag of the United States in a manner other than as suggested. Cases which have construed the former 36 U.S.C. § 17521 have concluded that the Flag Code does not proscribe conduct, but is merely declaratory and advisory."

I am sure that the city of Reno has a penalty for destruction of private property, however.

You used the word citizen.

These buttwipes that are doing this are not citizens.

If they were, they would not be flying a mex POS flag superior to the Flag of the United States of America.

And once a "non-citizen" (read illegal mexican invader) does it, in the United States, private property or not, with the sole aim of fomenting unrest, that is an act of war.

Period.

Does CNN have a flag on their headquarters? What if someone flew the FOX flag over the CNN flag as a prank? Would they still feel the same way? Just a thought!

No person shall display the flag of the United Nations or any other national or international flag equal, above, or in a position of superior prominence or honor to, or in place of, the flag of the United States at any place within the United States or any Territory or possession thereof: etc.

This is only for Gov't offices?

You had better read it again. It specifically states you MAY NOT display another nations flag above the US flag, that is not a guideline that is a specific statement, which means it is unlawful to do so. It also says it is NOT UNLAWFUL to fly the UN Flag above the US flag at the UN headquarters, which makes it very clear that IS it unlawful to fly a flag above the US flag at any other location. Nice try traitor, but it won’t fly. Kudos to the vet who cut the Mex flag down and took the US flag away and told them they would have to fight him to get the US flag back. The middle finger to CNN and the communists who run it.

You are right, it is not an enforceable law as has no penalties. Instead, the Flag Code is simply suggested etiquette.

However, theft is against the law in Reno and where ever the Stars and Stripes flies.
