The whole case is based on the testimony of Aldrete-Davila, a man they know told a number of lies to prosecutors, which was a violation of the immunity agreement. Prosecutors could have chosen to prosecute him for either the original instance of drug smuggling because he violated the agreement, or for subsequently delivering another load of drugs, which the prosecutors were aware that he did, but did not let him know they had found out. The drug dealers that he was delivering the first load for apparently insisted that he deliver another load after the first one was lost to the Border Patrol.
The border patrol agents' crime was that they did not report that they fired shots at a fleeing suspect that they thought was armed, and in Ramos' case thought was firing on Compean.
Another agent also reported seeing a person they thought was the suspect getting into a car on the far side of the river, so this isn't a situation where they thought they killed him and left him for dead.
The failed to do their duty to report that the shots were fired. They should have been appropriately disciplined for that. They are not completely innocent, but there wasn't evidence to suggest that they had tried to murder the suspect, and evidence that would have undermined his testimony against the agents was kept from the jury.

This two young, brave and dedicated agents are not criminals. The are good husbands and fathers. They have six young children to raise and have done a terrific job of it.

I wish I could get the transcript in a word program rather than pdf. For legal reasons the pdf makes it easy to refer to page and line number but for reading I’d love a copy in a more readable/printable format.
Anyway thanks for your input. I wonder about an organization that one feels it’s okay to cover up actions that are clearly reportable. We may need a total revamping of the agency, its leaders, etc. I’m not saying all are wrong or rogues but failure to follow protocol especially by those who are even charged with teaching it makes me wonder. Ramos got hammered on the stand about doing things their way....

Yea, I got the impression the whole office there was a bit lax in following official policies, and that the supervisors were trying to cover their rear ends on that account.
Illegal, drug-running alien scumbag crosses border into US.
US Border Patrol Agents Ramos and Compean intercept said alien.
Illegal alien scumbag assaults Compean, and turns towards Ramos with an "object" in hand.
Ramos, with pistol already drawn and fearing for his own life, fires at said illegal alien scumbag, hitting the drug trafficker in the buttocks as he turns to flee back across the border into Mexico.
The result? Agent Ramos successfully staves off an invasion and attack on US soil (an act of war), forcing the enemy to retreat back to where he came from. THAT'S a hero in my book! I don't know about you, but that's more than I've ever done to protect our country from this illegal invasion. Truth be told, it saddens me that this doesn't happen more often. My only advice to US Border Patrol Agents: Take more target practice, and don't forget the shovels!

You are whistling in the graveyard and there are many Americans who believe this was a test case for the pro-borders crowd to chill border agents from doing there jobs. Your pro legality stance will not carry the day. Do you believe in illegal immigration also?

It is HIS border policy to ignore border policy.
It is HIS six years sucking up to a third world lame-assed oligarchy and pimping for an open border that encourage the ever increasing flood if ILLEGAL activities - nearly all moving north from mexico.
It is HIS last minute dash to get amnesty through congress that has literally dumped the GOP on its butt for 2008.
It is HIS inability to choose and nominate conservatives and/or capable administrators that gave us Colin Powell, Chertoff, Gonzalez, etc.
It is HIS 'aw shucks' lassitude that lets the democrats ride rough shod over procedures and the rule of law.
It's that same failure to stand up that has demoralized sitting members of congress, that left him powerless even with a majority - which they then lost!
Significantly, it was HIS policy to put the National Guard on the border - then left them with rules of engagement that stressed retreat.
Getting blown away by law enforcement should be considered an occupational hazard for drug runners - shooting one of them should not be an automatic conviction for the officer. Read more than one report of the trial, see where the evidence was withheld, where jurors were misled and where jurors recanted afterward. Try to balance the trial instead of condemning the agents off hand.
Define what that 'very generous' deal was and tell us if you would have taken a sure jail sentence rather than presenting your own case in court. [and, if your answer is "I'd have never pulled the trigger in the first place" then you've never had to make the choice]
Lying and covering up is a minor offense for a law enforcement officier??
