I am telling you the only way to stop the abuse of this program is to add a $100,000 fee to the company for hiring an H1B person.

If you truly can’t find an american you will pay it no problem to get the work done. If you are pulling crap like this video is teaching and corporations are doing all over the place, you will stop the shenanigans because there is ZERO financial benefit to doing so.

You do this and you’ll see virtually overnight that there are maybe 10,000 to 20,000 total jobs in the US that can’t be done by an american, and most of these will fall into antiquated technologies that the US work force has abandoned, but still require ongoing support in some industries who have delayed upgrading.

My wife used to work for a privately owned Dutch company and they used similar ploys to bring their Dutch friends over at inflated salaries over Americans. They would use an obscure Dutch software and claim it as one reason, and the ability to speak Dutch as the other vital reason Americans could not do the work. Even though the software was not really used due to its inability to interface with anything and all their clients were Americans. A sham.

“And our goal is clearly not to find a qualified and interested U.S. worker. And you know in a sense that sounds funny, but it’s what we’re trying to do here. We are complying with the law fully, but ah, our objective is to get this person a green card, and get through the labor certification process. So certainly we are not going to try to find a place [at which to advertise the job] where the applicants are the most numerous. We’re going to try to find a place where we can comply with the law, and hoping, and likely, not to find qualified and interested worker applicants.”

This is what you get when you have a bunch of corrupt lawyers writing our laws for us.

THANK YOU! That is the bottom line. They belong in the judicial branch, NOT the legislative and executive branch. It creates an inbalance in power.

“...if it gets to the point to where they’re — somebody’s looking like they’re very qualified, we ask them to have the manager of that specific position step in, and go over the qualifications with them, if necessary, schedule an interview, go through the whole process, to find a legal basis to disqualify them, for this particular position...”

A couple years ago an advertisement from some company was posted. They came out and said the jobs were ONLY for foreign nationals and they put it in foreign papers. I suppose they complied with the law by showing a published “advertisement’.

I like the idea of an auction in stead of the current fixed-price (no-price?) "lottery" system. Then we'd find out what they're really worth.

Yes...I know....I’m an SPHR with years of experience, including in hi tech.....BUT, large businesses have become part of the PROBLEM....by aligning themselves WITH the government. Large companies here in WA state fight initiatives to get gov’t out of Affirmative Action and to reduce taxes.....I KNOW. I’ve worked on some of the initiatives. PLUS, lots of large businesses are now hoping gov’t takes over HEALTH Care so they can Pawn that off to the “gov’t.” Don’t get me started....LOL...guess I already started.....OFF my soapbox now....

You’re right, this is not capitalism. No more than when slavery was legal, THAT was not capitalism. You had to be a slave owner to compete at all or resign to poverty.

What we have now for a government is Corporate Oligarchy. The corporations and non profits (LOL)are writing the laws, not our legislators.
