I understand that. If some one burns a flag with 49 stars is it against the law??? What about a "paper" flag? all of these issues are unresolved and would have to be resolved by the courts.

It lost by one vote. Mitch McConnell and Bennett were two GOP who voted against it. There was one more, I cannot remember who. Most the usual RINOs voted for the ban.

Bennett's vote against the flag desecration amendment is no surprise to me. Many people don't realize that he has strong social liberal tendencies. He works hard to keep them hidden and his critics off-balance with his "aw shucks" genial nature.

Along the same lines, Bennett has been a strong supporter of federal hate crimes legislation and has pushed for federal government meddling in local zoning laws to make them comport with Kofi Anan's UN model.

A ban would just make it harder to identify the jerks who think the US flag should be burned. Besides, they'd only start burning it symbolically. What if it's one white star on a blue background, and a couple of red/white stripes? A symbol of the symbol.
Prohibitions have been known to start fads that would never have cropped up if there hadn't been a ban.
Flag burning is political speech and nothing's more 1A-protected than political speech. We'd do more damage to 1A by a ban on flag burning, than the burners could ever do to Old Glory.

A man could just as easily stand naked in full public view on his front porch and urinate on his dog, named "Uncle Sam," and claim it was political speech.

Except it wouldn't stop him frombeing prosecuted, would it?

Burning a flag in public is akin to dropping your pants and urinating in public. It's obscene, uncouth, wrong, and it isn't made acceptable by shouting "Thus to the United States flag!" as you dribble.

The most important amendment isn't even being discussed, the one to implement Jus sanguinis, where children born in the US have the citizenship of their parents and not automatically of the United States. That is what will protect the flag in the long run.
