Should Patrick Fitzgerald decide to continue to pursue the 2 counts in the Libby indictment even though the Judge has found impeaching evidence in Times documents, I suggest Libby may want to use this evidence of Coopers journalistic malfeasance to further impeach him.

In the original version of this story, TIME reported that one of the most damning pieces of evidence investigators have in their possession, John Sifton of Human Rights Watch told Times Tim McGirk, is a photo, taken by a Marine with his cell phone that shows Iraqis kneeling and thus posing no threat before they were shot.
While Sifton did tell TIME that there was photographic evidence, taken by Marines, he had only heard about the specific content of the photos from reports done by NBC, and had no firsthand knowledge. TIME regrets the error.

Time can always sneak in a retraction later when nobody is looking, once the story has gotten legs.

Lots of folks are going to be eating crow, once the facts are placed out on the platter and it is found the Marines stayed within the ROE.
The possibility of a U.S. massacre of Iraqi civilians could have major ramifications.
The writer clearly understands that just the allegations themselves may damage the U.S. and that he is helping that cause.
