Yep, pretty unConstitional. The government trying to defend its borders and control immigration. Where on earth did the federal government think it got that authority?

Is not border protection one of our greatest Civil Liberties?

It sure couldn't be Article 4 Section 4. The US Senate just threw that little bit of the Constitution in the trash.

Like Levin said....Mexico already has troops guarding their side so whats the diff.
The border is already militarized.

"The presidents proposed deployment of National Guard troops violates the spirit of the Posse Comitatus Act, which prohibits the military from getting into the business of civilian law enforcement," says Romero."
Posse Comitatus only limits the use of FEDERAL troops in domestic law enforcement. Doesn't apply to the NG.

This will be thrown out of court if the judge has any sanity left.

Plus border security is, always a national / Federal responsibility.

There are exceptions to Posse Comitatus.
Click here and scroll a bit for a brief discussion.
Applicable in this case: If the NG is operating under state authority and/or for illegal drug interdiction (which was passed by Congress, BTW, so the folks on the Hill can't plead ignorance).

The Mexicans should know that would be a bad idea.Americans don't react well to being sued by criminals.

IMHO Protection of the country's boarders is not the job of civilian law enforcement. It is the reason we have a military!!

The ACLU and Mexico suing the US govt for protecting the borders.
This will not be good for Democrats.

Jimmy Peanuts. LOL... i like the way you changed it...
Before i used to think and assume that on this aspect of American problems the President knows exactly what to do in favor of the country's interest as what is expected of him... but as things are going on recently, im not sure how the President and his folks will solve this crisis... just like any other country in the world, protecting the borders at any cost seems to be a common sense... but it seems to be very different with the Most Powerful Country in the World.

Well, FWIW, if I understood the folks on FNC this morning, technically it won't be the government of Mexico doing the suing. But the government of Mexico will be providing the lawyers to the illegals who want to sue. Maybe the Mexican government will be footing the bill for the ACLU, who doesn't seem to do as much pro bono work as it used to.

If President Bush doesn't wake up and realize that this is a hostile invasion then I'm afraid we are going to have a bloody war.
I teach ESL students in Texas and I've never encountered so much prejudiced hatred as from a huge percentage of my students, and it's all because I'm a white American woman.
I have to force them to stand for the Pledge of Allegiance. It's infuriating.
They hate us and they think that our country really belongs to them, so they have very condescending attitudes toward white people.
To: IrishMike
Enemies foreign and domestic that are placing this country in jeopardy. Let the socialist pigs file all the lawsuits they want lets. triple the National Guard now and let's tell foxy to shut up and we are suing them for telling a SUPER POWER what to do in OUR COUNTRY!!!
