RALEIGH, N.C. -- Durham County District Attorney Mike Nifong said he plans to move forward with his case against three members of Duke University's men's lacrosse team despite DNA results that do not match evidence collected from a woman who says the athletes raped her......(excerpt)

IT's important to add that during the course of the DNA investigation they swabbed the woman's body, 'orifices,' purse, cel phone, fingernails etc etc etc and FOUND NO DNA from any of the party-goers. Ipso facto, there is NO DNA evidence to suggest ANY of the party-goers touched her, grabbed her, restrained her, penetrated her etc etc AND the exam revealed there was no physical evidence the woman had endured vaginal or anal (sodomy was a charge) intercourse or injury. Sorry for being explicit.
Time to file a motion for dismissal. But then again, I don't think anyone has been legally charged with ANY offense.

I completely agree with your post. Both my children attend an out of town college; however, they are registered to vote here at home. This DA had made a political determination - pander to the folks who can vote. To me, he has tainted the case and jury pool from the onset of the investigation and done irreparable damage to the University and its students.

Nifong knows he only needs to get past the May 2 date of the primary election (I gather there is not even a Republican opponent for the general election), without looking bad in front of his base (Durham DemocRats). So I will not be surprised to see him try to string the process out for another three weeks and try to keep it from collapsing before then.
So today he goes to NCCU and tries to take the temperature of the crowd. Are they baying for blood? Or are they being swayed by the no DNA results? Assuming they are still agitating for charges, Nifong then consults over the next few days with his key supporters and contributors to sense what their current feeling is on the case. If the base and his key supporters are still wanting him to go after the Duke students, then Nifong takes his case to a grand jury and gets a true bill against three of the players, probably going after the ones who lived in the house.
During this time, Nifong publicly says little substantively about the evidence but does go to great lengths in interviews to talk about how people should let the justice system do its job, etc.
Weeks pass with little happening publicly, as the two sides prepare for trial.
Then, after the May 2 election, and probably well before trial, the case collapses, perhaps with the DA announcing that the charges will be dropped because the accuser is not willing undergo the trauma of having to testify, just wants to put it behind her, and the DA says he is not so inhumane as to force her to go forward.

Thats what he's aiming for the black vote.

They also have footage of her in a time stamped photo (from security type cameras I think) that show cuts and bruises BEFORE the alleged rape took place.
This woman scammed the prosecutor and it's going to take a few days for it to sink in with him.

This jerk, Nifong, has taken a page out of Ronnie Earle's playbook: Ruining lives through malicious prosecution all because of politics.
Sickening...

>>>Blacks are the racists.
That's an assinine statement. Just as foolish as 'all white people hate black people' and statements like this give FR a bad name. There ARE black racists. There ARE white racists. There ARE asian racists. etc...

As with other laws currently on the books, doesn't seem as though the government and the elected officials are enforced, much less followed. Seems as though the DA has more political ambition than sense of duty and fairness.
Explicit is not offensive at all concerning this case.......some people will not accept the complete lack of evidence at this point, not to mention DNA (male fluids) found on the woman that does not match any of the party goers....so, my question is, is that person(s) guilty of the crime of rape, or a john, or a conspirator(s) convincing the girl to attempt this fraud?

FWIW, from what I have read, there were NO (none) "male fluids" or any other evidence of recent sexual activity uncovered during her exam.
DNA tests don't require the presence of semen. And again, NONE was found -- of the party-goers or others(AFAIK).

A man who knows how the politiho's operate.....you seemed to have pretty well nailed it.
I'd like to see WRAL reinterview those that were so upset at the story (as to implicate guilt upon the players) and ask the question: So, what is your (your groups) stance with the DNA evidence proving there is no guilt upon the players?

There is no other vote in Durham.
The DA is in too deep. He has to prosecute or he risks looking like an idiot before a national audience. What he doesn't realize is that he is up against a whole lot of Yankee money behind these kids.

Good observation on the (no male fluids), but there's a story out there somewhere as to where that was oppositely stated 2 days or more previous. So, my question: Who is telling the truth in the DA's office? I'm trying to find the quotes to back that up......so, exactly how does it get determined 'recent sexual activity'? Cut marks, scrapes and bruises?

Durham is like a smaller New Orleans, believe it or not. Dems in charge, corruption at all levels, heavy social entitlements, etc....

See my post #21 above, and ...
The woman received (was subjected to) a complete physical. Post-rape-accusation physicals involving DNA tests are 'invasive.' They swabbed pretty much her entire internal and external surfaces for traces of external DNA -- hair, skin, saliva, seminal fluids and similar. They likely performed oral, anal and vaginal exams -- looking for evidence of bruises and tear and other physiological evidence. They should have looked at the arms of all the young men -- looking for scratches she may have inflicted during her struggles of being restrained and raped/sodomized by three men. They should have been able to find tissue bruises consistent with how she reported she was restrained. There should be dirt on her body (and other forensic evidence) consistent with where she was, and the position(s) she was in, on the bathroom floor (where the alleged rape(s) occurred.)
There's plenty of ways to gather damning evidence. So far the DA is "O-fer".
All this doesn't mean there is no evidence. It just means that so far there is no evidence to suggest the young men are guilty. Remember how we dinged Clinton for this -- "there's no evidence to suggest I lied/cheated/stole". IN other words, Clinton knew he got away with it. Maybe these boys are the same -- there's no evidence to catch them.
So far, it just looks like there's no evidence ... ;-)

There is money to be made for everyone but the players. If they are cleared, what good would it do to sue her?She has nothing, not even pride if she is a stripper,I mean'dancer'!I think she is seeking revenge[which has been accomplished],or hurt feelings because no one wanted to touch her.It costs money to hurt someones feelings.

she should be criminally prosecuted for making a false accusation. if there are no repercussions from lying about being raped, innocent lives will continue to be ruined by the vindictive, and otherwise motivated liars.
