NORTH MIAMI

An armed assailant bent on robbing a man near a North Miami gas station Tuesday chose the wrong victim -- an armed one -- and paid with his life.

Miami-Dade police spokesman Detective Roy Rutland said instances of armed victims successfully defending themselves against armed assailants are fairly rare.

No charges will be filed against Phillips.

Because most of the time there is nothing to report. No shots fired. No robbery, no rape, nada.

If there is no bloody body or wounded bad guy, the police generally don't count it as a successful defense. Most of the time the assailant decided to find someone else to assail, and vacates the area ASAP. They aren't interested in getting killed or wounded.

Police see 2-day rash of holdups; lone arrest
By Amanda Iacone
The Fort Wayne Journal Gazette
A 19-year-old man tried to hold up a food shop at Glenbrook Square without a weapon about 11:30 a.m. Wednesday. According to police spokesman, the man got into an argument with the clerk of Yogurt Express and walked away without any money before he was stopped in Sears.
Police said Dwaylian Gray walked up to the clerk at the yogurt shop and asked whether the store had any cameras. The clerk said no, and Gray then told her he was robbing the store and wanted money from the cash register.
Gray moved his hand to his hip as if he had a gun, but the clerk refused to give him any money. Gray allegedly asked the clerk whether she was afraid, and the clerk responded, “I fear only God,”
The two continued arguing, and Gray pulled out a pen and paper, wrote a hold-up note and gave it to the clerk. But the clerk still refused to give him any money.
Gray left a short time later. He was unarmed when he was stopped in Sears. He was arrested and charged with armed robbery because he threatened that he was armed.

most chiefs and their "spokesmen" don't speak for the rank and file

I have yet to hear of any of the rank and file failing to enforce gun laws. In fact when you read about some poor schmuck's gun collection being seizured, it's the rank and file that does it. You don't go in a career in police work because you think that some laws are stupid and shouldn't be enforced.

Yeah, but that was a couple of days ago. I didn't see it, then. Folks who may have missed that one might want to see this one. I could understand if it was posted ahead of me by minutes or hours, but c'mon! Besides, I was cheering for this one in my classroom of seniors! I teach in a inner city high school in Miami. Great stuff for a good social studies discussion. I figure since I'm in the city in which this happy ending ocurred then I ought to post it, too. Got a problem with that?

Are police spokesmen really law enforcement or are they PR?

Are spokesmen called detective?

That's pretty much what happened the one time I used a firearm to prevent a home invasion (with wife and daughters in bed). The rackety-rack of a pump gun made him decide to look for a flatbar fight elsewhere. That part was not reported to the Sheriff's Dept; they didn't ask, I didn't tell.

A little more patience and you could have bagged one. (just kidding.....kind of)

(I say that as a former Floridan who misses my state!)

I hope you only miss the North & Central part of FLorida;

The only good things left in South FLorida are good, solid-Biblical, GOD-belieing churches & The Everglades.

I grew up in Hialeah and most recently lived in Hollywood. Moved to NC to get away from So. Fla. but you have to admit in Florida there's never a dull moment.

I've often wondered if these instances of perps being killed by armed citizens defending themselves -- is an example of the 2nd Amendment working or evolution working.

More and more, I'm leaning to the evolution concept...
Violent criminals SHOULD be killed.. the 2nd Amendment simply makes it possible for citizens to execute the bastards...

Kalifornicate certainly won't kill them fast enough to protect society.....Armed citizens expediting "evolution" would be faster in our case.

Actually, I can't beacuse there are more than a few [dull momments] for me whenever I'm at work in the downtown Coral Gables office building my company is situated in.

I'm more of an Outdoorsman at heart and long for some REAL wilderness & wildlife.

I attend one of those churches. Bible study tomorrow night, in fact.

We've got a great IDPA club, too! BANG

If you're in the area, check the site calendar and drop by!

OH NO! How bad is it? What about surrounding areas (Hendersonville, etc)? We want to move there primarily for the big VA Hospital.

Sorry. So many folks here just can't wait to do a search and try to get a mod to remove the thread. It seems to be a game and it makes me mad. I didn't mean to get snide. :~)

There are some beautiful areas around here. Hendersonville is growing fast, though I don't go down there much but they have the cutest downtown. Asheville has a great downtown, too. Asheville has a large (so they say) homosexual population but I mostly ignore them. We had a pro-marriage demonstration downtown a few years ago and the homosexuals who showed up really embarrassed themselves and several arrests were made. Quite a show - lol. But there are a lot of good, kind-hearted people here and the churches are great. Of course winter can be a pain but it sure makes you appreciate spring!

In England, they'd probably throw this guy in the slammer for using excessive force

England, heck in several US states, Massachusetts comes to mind, they'd probably do the same. Probably in NY City too. In many others, the would be victim would not have been able to be legally armed, unless he was a Sports figure, a movie star, or some politicians relative.
