ARMED ASSAILANT IS SHOT BY VICTIM

NORTH MIAMI

An armed assailant bent on robbing a man near a North Miami gas station Tuesday chose the wrong victim -- an armed one -- and paid with his life.

Miami-Dade police spokesman Detective Roy Rutland said instances of armed victims successfully defending themselves against armed assailants are fairly rare.

No charges will be filed against Phillips.

Instances where a legally armed victim smokes the perp are rare

Not rare at all, according to Gary Kleck - non-police killed about 2.5 times as many felons as did police in the years he studied it ('80s)

The article does have that unfortunate hiccup in it, but at least the article (and the headline) is clear on which actor the "victim" is, and reassures readers that the victim will not be facing any charges. A Miami TV station's website carried an article on this incident yesterday, and correctly mentioned the "victim" no fewer than 5 times.

I'm getting feeling there's some conscious push for this in the South Florida media. Seems new to them, though, since they're having a little trouble keeping track of who's who while writing in this new language. The Herald had to print a correction today, to the article you posted:

"A brief story that appeared on 3B of the Metro & State section on Wednesday incorrectly described Smith Phillips as a victim in an armed robbery. He was the alleged assailant; the victim's name was not released by police."

That is a lie.. It's rare when a victim kills an assailant. Usually they scare them away.

Can't pull up the article but the headline tells me all I need to know. Another violent felon retired. Nice work. As a side note, the police detective is totally useless. With luck, he'll find a new line of work.

Instances where a legally armed victim smokes the perp are rare, but I'll bet the vast majority of incidents results in the bad guy running away with a new brown stain in his trunks rather than with him in the morgue.

That's pretty much what happened the one time I used a firearm to prevent a home invasion (with wife and daughters in bed). The rackety-rack of a pump gun made him decide to look for a flatbar fight elsewhere. That part was not reported to the Sheriff's Dept; they didn't ask, I didn't tell.
