3 Charged With Planning Attacks in Iraq (News conference at 1:30 PM EST)

CLEVELAND

A federal grand jury has indicted three Ohio men on charges of planning attacks on U.S. military personnel in Iraq, according to an indictment.

The three men, who all lived in Toledo within the last year, were arrested over the weekend, said Assistant U.S. Attorney David Bauer in Toledo. The indictment was unsealed Monday.

They were to be arraigned in federal courts in Cleveland and Toledo on Tuesday afternoon.

The suspects recruited others to train for a violent holy war against the United States and its allies in Iraq, the indictment said. The group traveled together to a shooting range to practice shooting guns and studied how to make explosives, the indictment said.

that this in no way took away the Constitutional authority of the president to override the new law if the president thought it was necessary to protect the citizens of the country
I've heard this before and have searched the Constitution for this authority. I have written my congressmen and three Presidents to try and find out what clause granted the executive the authority to over ride law. It is not there.

In addition, I do not concede that it is an either/or situation with regard to wiretapping. All I'm saying is that we currently have provisions in law to allow such things. I have no problems with changes in the law that adjust to keep up with technology. For example, if one gets a warrant to tap a phone for a person, then it should be good for any phone - or for that matter communication technique such as e-mail, that the person gets without having to get a new warrant for the new number. However, I am not willing to give up the warrant altogether. Secret charges, trials in absentia, etc. fly in the face of the very foundation of limited, unrepressive (if that is a word), government.

Unlimited government has never in history continued to allow the people it governs to be free, never.

When the government is unrestrained then you are no longer a citizen, you are a subject. You may have a good king from time to time, but you are still a subject.

I would caution you about taking anything that the Government says without question. Look at the options we were given in Vietnam. Either support your governments no win policy, or support the "hell no we won't go" gang. "Wait a minute, what about winning?", no either support your governments no win policy, or support the "hell no we won't go" gang - which one is it? Well it was neither for me.
Same with this war. I want to win it without destroying our nation. Currently, all the enemy has to do is hit every 5 or 6 years and sit back and watch us hemorrhage.

We can win this thing without eliminating our form of government but it will take the sheep stepping out of the flock and paying attention.

IMHO.

Justice appeals court ruling limiting information sharing


WASHINGTON (CNN) -- The United States has broad authority to use wiretaps and other surveillance techniques to hunt for suspected terrorists, a federal appeals court panel ruled Monday.

In a 56-page opinion overturning a May decision by the Foreign Intelligence Surveillance Court, the three-judge panel said the expanded wiretap guidelines sought by Attorney General John Ashcroft under the new USA Patriot Act law do not violate the Constitution. (More on the USA Patriot Act)

The ruling by the special panel from the U.S. Circuit Court of Appeals for the District of Columbia gives broad surveillance authority to counter-intelligence and counter-terrorism investigators to track individuals considered potential national security threats.

"Our case may well involve the most serious threat our country faces," the panel declared.

The reversal of May's decision by a federal judge represents a victory for the Justice Department and the FBI, which were harshly criticized by the lower court judge for its handling of wiretap applications, and their interpretation of the authority granted the government by the USA Patriot Act

If they hang them, they will have to hang Carter and bubba also. They've also given comfort to the enemy in time of war. I would have no objection to any of that happening!

The three judges made up what is known as the FISA Court of Review. It was created in 1978 by the now-famous Foreign Intelligence Surveillance Act. The act required that the president go to the so-called FISA Court to seek a warrant for surveillance in top-secret foreign-intelligence cases. For any disputed decisions that might arise, Congress also created the Court of Review, a sort of super-secret appeals court.

But in all the years between 1978 and 2002, there had never been occasion for the Court of Review to actually meet. Not until Sealed Case, and the three-way collision between the executive, legislative, and judicial branches that it involved. Today, a look at the circumstances of the case provides not only an insight into the administration’s rationale for the secret, warrantless surveillance program but also important clues to the mystery of how the whole thing got started in the first place.

The entire session lasted just a few hours, and the Justice Department waited for the Court of Review’s ruling. When it came, in November 2002, it was a slam-dunk win for the government.

I don't know where your research took you, but it seems to have missed this tidbit:

Not only could the FISA Court not tell the president how do to his work, the Court of Review said, but the president also had the “inherent authority” under the Constitution to conduct needed surveillance without obtaining any warrant — from the FISA Court or anyone else.

the three communicated by computer with an individual in the Middle East, passing information about potential attacks and terrorist training materials back and forth, as well as communication about potential weapons and targets.

I'm guessing that communications stopped or were severly curtailed after the NYT revealed the NSA program. There being no more useful intelligence to obtain from this bunch as a result, the government went ahead with the arrests.
