Not All Drug Dealers Are Created Equal
The Loft ^ | February 1, 2006 | Chuck Muth

Bernabe Rivas of Carson City, Nevada, was busted for trafficking in methamphetamine, reports the Nevada Appeal. A felony. But rather than prosecute the illegal drug dealer on the felony charge, District Judge Bill Maddox sent him to drug court…over the objections of the drug court committee which reviews and approves such cases. By having his case heard in drug court, Rivas avoids the possibility of being convicted of a felony. Instead, he simply has to take frequent drug tests, keep a job and not get busted again for the next two years.

Now here’s the kicker…

The reason Judge Maddox sent Rivas to drug court instead of prosecuting him for felony drug trafficking is because Rivas is…an illegal alien. And if convicted of a felony, Rivas would be deported back to Mexico, along with his two kids.

Can you believe that? How many LEGAL Nevada citizens in the same situation would receive such kid-glove treatment if pinched for drug trafficking in meth? Indeed, Judge Maddox, on January 18th, sentenced Dennis George Folliott “to up to 10 years in prison for manufacturing methamphetamine in an apartment he shared with his 9-year-old daughter.”

At the risk of being accused of defending a meth dealer, there’s something patently wrong about sentencing an American father to up to ten years in prison, while slapping the wrist of an illegal alien father for the same thing.

And some people still wonder why so many Americans are so fed up with the illegal alien problem in this country?

It sounds crazy. Is there any chance that there is more to the story? I am not sure what more there could be, but would like to think such madness does not happen in our justice system.

I guess he was just doing another job that Americans won't, errr, can't, do (because they get put in prison for it).

Of course, most of us believe he should be sent back just because he IS an illegal, irrespective of his drug charges.

I think not. If this guy's a drug dealer, and we send him back South, then he'll just come back later. With more drugs.

Death penalty for trafficking in drugs, or life in prison. Cane the SOB's caught with small amounts, for first offense. Test them for a year, and cane them again if they test positive. Test them for another year, if caught dirty, life in prison. If I were dictator, this stih would stop very quickly

Here's another story on it.

Sounds like breaking the law runs in the family. Thank goodness for those two anchor babies of his who keep his sorry butt here in the U.S.

In another case, Bernabe Rivas, 22, a Mexican national who came here with his family when he was 5, was allowed to have his charge of trafficking deferred to drug court, despite Langer's protests.

In drug court, if Rivas completes all requirements, the charge will not go on his record. Felons are not allowed to become U.S. citizens or enter the country legally, his attorney noted, adding Rivas is the father of two small girls born in the United States.

Maddox took the children into consideration when agreeing on the court change.

"If he gets convicted of this then he's getting deported. His children are American citizens who will have to spend their life in Mexico," Maddox said.
