Glum Democrats Can't See Halting Bush on Courts

Disheartened by the administration's success with the Supreme Court nomination of Judge Samuel A. Alito Jr., Democratic leaders say that President Bush is putting an enduring conservative ideological imprint on the nation's judiciary, and that they see little hope of holding off the tide without winning back control of the Senate or the White House.

In interviews, Democrats said the lesson of the Alito hearings was that this White House could put on the bench almost any qualified candidate, even one whom Democrats consider to be ideologically out of step with the country.

That conclusion amounts to a repudiation of a central part of a strategy Senate Democrats settled on years ago in a private retreat where they discussed how to fight a Bush White House effort to recast the judiciary: to argue against otherwise qualified candidates by saying they would take the courts too far to the right.

I think the ACLU deserves a big "thank you" from conservatives.

ACLU fanaticism educates the public every day on the dangers of judicial activism. The left's war on religion, pampering of criminals, and bizarre obsession with the rights of NAMBLA and Al Queda members has turned a lot of people off to the idea of activist judges.

The man on the street has more common sense than NOW and NARAL, in their arrogance, believe.

I noticed that there were several examples shown of the Democrats holding the position that the American people are not smart enough to know what they want--that they just don't understand what is happening!

This is not only insulting, IMO, it is a wrong assumption on their part--and will continue to bite them in the butt!

All of the grumbling about Kelo is misplaced. As a distinct ideological political group, we, basically conservative folks, prefer that issues that are capable of being within the control of the several states on an state-specific basis should be exactly that. The end result of Kelo is that it is the obligation of each state, either through specific legislation or authoritative case law expressed by the state's highest court, to define the term "public purpose" when a taking of private property is the issue. Several states have already recognized what the Court actually said in the holding of Kelo and have responded accordingly. Thus, Kelo is properly neither a Democratic nor Republican election issue. But, politics being what they are, the spin put on the case will be political rather than analytical and truthful.

No. That was not the lesson of the Alito hearings. That was the lesson you should have been taught in grade school. The lesson of the Alito hearings is that most of the Dems are so out of touch with reality that they're just figuring this out, and most of us knew that already too.
